The regular monthly meeting of Yoe Borough Council was held on December 11, 2007 at the Yoe Borough Municipal Building, 150 N. Maple Street, Yoe, PA. The meeting was called to order by Council President Sam Snyder at 7:03PM with
the Pledge of Allegiance.

Minutes
A motion was made by Councilman Allar to accept the minutes of November 13, 2007 as presented. The motion was seconded by Councilman Howett. All
in favor. Councilman Snyder said minutes approved.

Visitors

Councilman Snyder said under the visitors section, since we do have an
open council seat, the notice of the open council seat was duly advertised in the paper. Do
we have any individuals here that would like to be considered for that position? Stand up and introduce yourself. Seth Noll said I am a resident at 245 S. Main Street, Yoe. I’ve been a resident for a little over six years now and I am interested in the council seat. Councilman Snyder said very good. I know some people have had some dealings with Seth over the last couple of years. Any questions that you would want to ask Seth? Councilman Allar said I think Seth would be a great addition because of his background and his responsible position. I think he has the best interest of the borough at heart.

I definitely recommend him. Councilman Snyder asked are there any other visitors that would like to be considered for the open council seat? Have we received any interest via mail? The secretary said no. Councilman Snyder said then I only have a couple questions.
Are you over the age of eighteen? Mr. Noll said yes. Councilman Snyder said are you a
registered voter? Mr. Noll said yes. Councilman Snyder asked, a U. S. citizen? Mr. Noll said yes. Councilman Snyder said you already mentioned that you have been a resident for more than a year. A motion was made by Councilman Allar to appoint Seth Noll to the open council seat. The motion was seconded by Councilman Crull. All in favor. Councilman Snyder said, welcome aboard. I’ll turn you over to the mayor for the following.

Swearing in of Councilman Seth Noll

Mayor Sanford asked Councilman Noll to come up front please. The oath was given with Councilman Noll raising his right hand. “ I do solemnly swear that I will support, obey, and defend the Constitution of the United States, and the constitution of the Commowealth and that I will discharge the duties of my office with fidelity.” Mayor Sanford said welcome.

Councilman Snyder said you can get with the secretary at your convenience to fill out the appropriate paperwork, fill out the ethics statement, W-4.

Solicitor’s Report

Executive Session at 7:08PM

Attorney Solymos requested an executive session to report on litigation to council
A motion was made by Councilman Allar to recess the regular meeting at 7:08PM and move into executive session. The motion was seconded by Councilman Manns. All in favor.

Councilman Snyder said we are running a little late on the public hearing for ordinance 2007-04.

Councilman Snyder said we are reconvening the regular meeting at 7:34PM. Let the record reflect that we had discussed legal matters. The first issue, we’ll take the second one first. It was discussed about the legal opinion on the access of the dams as written in

in the legal description of our deeds and the legal opinion is that, that it is a general access for maintenance to the dams and do we have a motion then for Tom to proceed with negotiations between the Township and the property owner to move that easement down
closer to the creek. A motion was made by Councilman Howett to have Councilman Allar proceed with the negotiations. The motion was seconded by Councilman Crull. All in favor. Councilman Snyder said motion carried. The second issue that was the solicitor bringing up to council that a writ of summons was filed today against Mr. Chronister, his partner and his partnership.

Recess of Regular meeting and Public Hearing for 2007-04

Councilman Snyder said ordinance 2007-04 was advertised for 7:30PM. A motion was made by Councilman Allar to recess the regular meeting at 7:35PM to go into public hearing to discuss that ordinance. The motion was seconded by Councilman Howett. All in favor. Councilman Snyder said the meeting is in recess.

Councilman Snyder said the hearing is for discussion of ordinance 2007-04, an ordinance fixing the millage rate for the year of 2008, for general revenue purposes. Section 1: The millage rate for general revenue purposes for real estate tax for the year 2008 is here by fixed at 2. 955 mills. The millage rate for the annual fire tax for protection for the year 2008 is hereby fixed at .103 mills. Is there any discussion from the public? Is there any discussion on council? I do have one thing to add. We did get notice from the Board of Assessment Appeals from York County, that their resolution passed which they validated the assessment for Yoe Borough for the year. Our total assessment is $30,628,060.00 with $1,576,820.00 being tax exempt for a total valuation of $32,204,880.00. I just wanted to bring that up to let everyone know that based on the approximate 3 mill that we will be passing that would generate roughly $90,000.00 in income which of course last year we were $5,000.00 off for whatever reason so we should be on target for the $85,000.00 that we have budgeted with adopting this millage rate. Any discussion from council? A motion was made to ordain ordinance 2007-04 by Councilman Crull. The motion was seconded by Councilman Manns. All in favor. Councilman Snyder said, so be it ordained.

Adjourn the Public hearing and reconvening into the Regular Meeting

A motion was made by Councilman Howett to adjourn the public meeting and to reconvene the regular meeting at 7:40PM. The motion was seconded by Councilman Manns. All in favor. Councilman Snyder said hearing is adjourned.

Red Lion Solicitor Solymos said with regard to the Red Lion zoning officer. I made
Zoning some suggestions, in regards to the contract that was proposed by council
Contract with Red Lion. We made those changes. Legally its fine now, prepared for
you to vote on to enter into that contract. Councilman Snyder said we will
be doing that after we come out of the ordinance hearing.

Joint Solicitor Solymos said there’s one other thing, let me see if I can do this
Comp Plan quickly. Tom is in the process of working with our sister municipality,
Red Lion and now with Dallastown with an eye towards a, to draft a
joint comprehensive plan for the three municipalities. Two ways you can
do this, that is by creating a single zoning hearing board or by getting a
joint comprehensive plan and the following that comprehensive plan by
creating your own zoning ordinances with those. There was rumor at the
last meeting, that Dallastown wasn’t interested in this whatsoever. So I
contacted Pam Shellenberger at your request. She was very helpful and
illuminated on the issues. She also thought that maybe Dallastown was
uninterested, but it turns out through Tom’s work, that Dallastown is in
fact interested, and will probably go through with it. I called their solicitor,
he had no idea that Dallastown was interested or anything else. They
hadn’t talked to him about it but now he knows about it. I think everyone
move on it. Councilman Allar said there is a memo being worked on right
now, in fact we might have had it faxed or emailed. It’s a MOU that would lock in the three municipalities to this joint comp plan. I talked to Stew in
the last few days, it should be coming in. I know Pam Shellenberger of the
county.. Solicitor Solymos said I’m really bad, MOU? Memo of under-
standing? Councilman Allar said right. I talked to Pam today, she has a
copy, I know its been circulated. I’ll get a copy, give it to Sandy then she
can copy it to you. But we do need to get closure on this. I’ve got meetings
in January with the other municipalities. And they’re going to want to know, that we’re in sink with this agreement. So Pete will need to take a
look at this as well. Councilman Snyder said that’s what I was going to
say, I think everyone on council knew that we were investigating this at
the last meeting. I think now because there were more discussions that
Tom held with Red Lion and Dallastown and with the solicitor. I think
We do need a formal motion at this point so Tom feels comfortable with
expending these funds that council’s on board with pursuing this and
then if any MOW does come through after review by our solicitor, for
his approval, the borough can go ahead and sign this and the borough
proceed in trying to get on board with the three way. Councilman Allar
said one of the many values of the comp plan. Its getting more and more,
when you go for state money, the question is raised in either an application
or in other ways, is this part of your comp plan? And its even to the point

that actually some denials occur because there wasn’t a comp plan. It
forces municipalities to update their plan. Ours goes back to 1962 so,
it could affect us if we don’t do this, in a monetary way, at some point
with the money. Solicitor Solymos added that the state likes this also,
for the operation, that you are working together and that saves money
for everyone technically. That’s really an important part of the plan.
A motion was made by Councilman Howett for the borough to
Proceed with investigating this joint municipal comprehensive plan and
of course after review with the solicitior to sign any MOU that would come through to further along this joint endeavor between the three
municipalities. The motion was seconded by Councilman Noll. All in
favor. Councilman Snyder said motion carried.

Recess for Public Hearing for Ordinance 2007-5 and Recess of Regular Meeting

A motion was made by Councilman Allar to recess the regular meeting at 7:45 PM while
we go into public hearing. The motion was seconded by Councilman Howett. All in favor. Councilman Snyder said meeting is recessed.

Public Hearing for Ordinance 2007-05

Councilman Snyder said I will bring to order the public hearing as advertised for 7:45PM to discuss ordinance 2007-05. This is an ordinance for the Borough of Yoe, York County,
Authorizing the Borough of Yoe to enter into an inter-governmental cooperation agreement with Red Lion Borough to provide zoning officer services to Yoe Borough
providing a severability clause and providing an effective date, Ordinance 2007-05.
Everyone had an opportunity to look over this in their packet. As we discussed; myself,
Peter and I’m not sure but Tom may have had some discussions with Pete and Red Lion.
We got this pretty much the way we want it as well as the agreement which was discussed in the regular meeting. Is there any public comment on ordinance 2007-05?
I will make one public comment on behalf of our current zoning officer. I know it
probably came as a shock to you, but this was done mainly, we see this as an option that the borough can save money in trying to join services with another municipality. Not really to try to take this as a reflection on yourself but more on the financial end. We think that Yoe Borough would be better served with zoning services with Red Lion Borough. We want to thank you for the couple years that you’ve been here serving Yoe
Borough and when you were here one month, you were in litigation. We will be working with you on that in the future. I’m not sure how that will affect that litigation. We can discuss that later. We want thank you for the time spent with us. Any discussion from council on ordinance 2007-05? From the mayor? A motion was made to ordain ordinance 2007-05 by Councilman Noll. The motion was seconded by Councilman Howett. All in favor. Councilman Snyder said so be it ordained.

Agreement with Red Lion for Zoning Services
Councilman Snyder said first order of business since we’re still in Solicitor’s Report and since we just passed ordinanace 2007-05, discussion on the actual agreement between Red Lion and Yoe borough for the services of the zoning officer. Pete, do you have anything further? Solicitor Solymos said no, recommend it as amended and with the suggestions put in it. Mike was easy to work with and understood what we were
Suggesting. I think it is a good agreement. Councilman Snyder said I did have an opportunity to get in touch with the borough manager. We made a couple of revisions
to this that I’ve seen. Then of course I met with Pete, we had gone over some of the issues that he had, had. Its basically everything that we’ve discussed Tom, at the meeting that you and I were at. It looked good to me. Did anyone else? No one got a copy because there were so many revisions, it wasn’t sent out with the packet. Everyone will received a copy of this in their next month’s packet so. Plus Red Lion will. This is the most current one? The secretary said this is the one that you put into the folder. Councilman Snyder said yeah, that is the latest one. I see they took out very six months. So that’s the latest one. Solicitor Solymos said there should be something in there that everything should be put into writing. Councilman Snyder said yeah, and that they’re actually allowing e-mail to be in writing. Solicitor Solymos said yes, e-mail is fine. Councilman Snyder said
these are some of the other ones that I see in blue and stuff. It says borough council, in
the event the agreement is extended beyond its initial term, it shall be then considered
automatically under the terms and conditions therein until terminated by either party. So
this is the latest, I just wanted to make sure we are signing the latest one. Any other discussion, if not? A motion was made by Councilman Crull to sign the contract with Red Lion Borough for zoning services. The motion was seconded by Councilman Allar. All in favor. Councilman Snyder said motion carried. I guess, Barry has been in touch with you then on a smooth transition between. Mr. Baade said he said he’d give me a call but I haven’t heard. Councilman Snyder said okay. You don’t actually have to wait on him, if
there’s going to be a time that’s more convenient for you and you don’t want to wait on Barry, just feel free to give Dan Shaw a call at Red Lion. Mr. Baade said I don’t know him. Councilman Snyder said just give him a call and introduce yourself, say hey, I’m
Richard, I’m the zoning officer. Mr. Baade said Barry said he wants to set it up and he wanted to sit in on it. Councilman Snyder said Barry’s not here, so I don’t know where we’re at and just go ahead and feel free to make that call and give Barry the heads up, say I put the initiative in, I set it up and this is when its convenient for us. Councilman Allar said if at all possible I think Barry should be there. Councilman Snyder said yeah, Barry

should be there. Councilman Allar said Dan may have questions that Dick can’t answer, policy questions. Councilman Snyder said I’m only concerned if Richard is saying that
Barry hasn’t contacted him yet, and we’re already at the eleventh. I don’t want, all I’m going to say is that we have to proceed with this and we have to make it happen by January 1st. I can’t sit here and point a finger at him, I don’t know where he’s at. Councilman Allar asked if we could give Barry a call? Mayor Sanford said he’s in a meeting. Councilman Allar said I don’t’ mean right now, tomorrow. It could be set up for this week yet. Councilman Snyder said yeah, they can. Councilman Allar said its just
that Dan may have policy issues. Councilman Snyder said yeah. Councilman Allar said and its not going to go anywhere, Dan’s not going to know about it. Councilman Snyder said I just don’t need this, you know what I mean. Councilman Allar said yeah, I know. Councilman Snyder said I’m sure you’re going to cooperate with us then, at this point maybe Dan’s heard something. Councilman Allar said he hasn’t, he has been wondering about the meeting. I told him its going to be set up.

Garbage Solicitor Solymos said I don’t’ have anything else that I’m aware of.
Contract We’ve covered an awful lot, and we’re doing a lot of stuff here. Sam and I
are going to meet with regard to the garbage contract. We’re looking for a
bill to see if they’re mixing before we get together. We suspect that they
are and that would be a violation of the contract. We tentatively scheduled
it for Thursday and since we don’t have the formal documents in, we’ll do
it as soon as they come in. So Sam and I will meet on that. So that’s all I
basically have on that. The secretary said we received our new bill for
November and the $480.00 is added in so that isn’t listed on the bill list to
be paid so that balance is still carrying on the account.

Box/Swale Councilman Snyder said an issue that was brought up after you left last
Elm St. month, it actually came up under maintenance. Did you want to ask the
question or tell Pete what you want to ask about that culvert up there on
Elm Street that I said that we’re not going to do anything until they come
to council and that’s going to be something the solicitor has to comment
on. Mr. Shearer said we have up on Elm Street, a drain box in the street
pipes into a preformed concrete box that has an open end that goes into
a swale. When we had some problems up there this summer with the gas
company work, the home owner there requested that I look into having a
cover made for this concrete box. And in talking with Ron and Sam, I
guess the borough’s opinion has always been that, that’s private property.
Solicitor Solymos asked is this the same one I look at one time up there?
Councilman Snyder said that was the one close to my house, this is the
same thing where a box dumps into a swale, and the swale runs through
private property. Solicitor Solymos asked if the box was built by a private
individual? Councilman Snyder said well I think the box was built by us
but the water comes out of it and runs across private property. Solicitor

Solymos asked an actual drainage course or did we move it there?
Councilman Snyder said probably the same thing as we have back on our
street and the thing is that they’re now saying they’re going to have a baby
in a couple months and they want us to do something at this swale. And I
said based on prior history with. Solicitor Solymos asked what do they
want us to do, put a pipe in right? Mr. Shearer said all he requested was a
cover for the box so they child couldn’t fall into it. Solicitor Solymos
asked a cover for the box in the street? Mr. Shearer said no, no, for the one
in the yard. A concrete box that is covered over with dirt and grass and
there’s about an eighteen by eighteen opening that you can actually crawl
up into a 20 foot or so to the back side of the drain box. Councilman Allar
said there was another situation a couple of years ago where stakes were
put down or hammered down, I think to keep a child or young kid from
getting to the box on Elm. Mr. Shearer said that’s on the other side.
Councilman Snyder said that’s on the upper side. Mr. Shearer said that’s
where this water is coming from. Councilman Snyder said but that was
put in right there on the right of way. This actually, well image Wendy
Tyson’s closed in box culvert. The only difference, that had naturally
running through it. This is strictly for stormwater but is running their
yard. And this is closed in. Solicitor Solymos said someone put it in
years ago. But you don’t want to go and read the minutes over the past
ninety years. Councilman Snyder said we probably should say the same
thing like we did up at Park. Mr. Shearer said from my understanding, if
I’m not mistaken here, Ron, you said the borough didn’t do that.
Councilman Crull said I own the property right up there along side of it
and the yard is probably 150 feet long. And this culvert was put in, they
put it in to make it easier to mow grass. And they only went about half
down the yard. Then they stopped from that point it dumps out into a
swale and runs back out into our alley. I know it was done just to make it
easier to mow grass. The borough didn’t do that one whereas the one
you’re talking about, we did do. Councilman Snyder asked the one?
Councilman Crull said the one up behind your place. Councilman Snyder
said I know the borough put that in. Councilman Crull said there’s been
at least seven to eight different owners up there on the house over the
last twenty five years. Solicitor Solymos said I think its private but just out
of curiosity what’s going to set him back to put a screen in it? No big deal
is it? Mr. Reichard said, we have details on that, its just a bar bracket you
put in with hinges and a lock, a couple hundred to build. Councilman
Snyder said I think at this point what I was recommending at council last
month, council not take any further action at this time. They’ve
approached Dana but they haven’t officially approached borough council.

You needed to be apprised of it because this is déjà vu all over again.
And its on the radar. I’m just telling you, its on the radar. But I think
at this point no action and if they come forward again, then take there.
Yeah, we’re going to have to have our engineer look to see about it.
Even then I mean so the engineer says yeah we diverted the water. We
diverted the water back there on Park Alley, we still took the position
that its running across private property so we’re going to let it go. If
that’s the case, then let’s, this is your call. Solicitor Solymos said I’ll make
it when it gets to that. Councilman Snyder said I just wanted to get you up
to speed, it came up after you left. Solicitor Solymos said this is not a
situation where you as a community could say look we can’t do it however
our engineer would be glad to come over and tell you what needs to be
done and give you an idea what it might cost you. You may want to
consider doing something like that. I don’t’ know if you even need an
engineer or not, you can tell them what needs to be done. I don’t see
opening that pandaro’s box. Councilman Snydre said I just wanted to
give you the heads u, because it came up after you left.

Amendments Solicitor Solymos said the only other thing I have was that I got a
To Zoning heads up about five minutes before our meeting that Jason has proposed
Ordinance certain amendments to the zoning ordinance with regards to buffering
and screening and there here for your review and comment. I have no
comments but with Jason’s expertise here, I’m sure we need it. I have
to just put in the appropriate form for adoption in an ordinance once you
folks had a chance to look it over and decide what you want to do with it.
Councilman Snyder said Jason didn’t have an opportunity to copy, to
make numerous copies to everybody. I think there is three floating around.
Four cause the solicitor took one. Now you did say that at a pre meeting
discussion here, you did say we could advertise this for adoption and
could start enforcing this even before its actually adopted and even goes
to the planning commission, YCPC. Do you recommend , do you want a
motion to actually advertise this awhile? Solicitor Solymos said first of
all I don’t want to advertise it until you guys, the board, council have
a chance to review, answer any questions they have and if not, then I’m
told to prepare the ordinance. Then I’ll prepare it and advertise it, we’ll
advertise it for adoption, we’ll ship it out to York County Planning. The
interesting thing is doing this right, York County Planning meets the first
week, we could do it in such a way that we might have all reports. No,
wait a minute, no, we meet the second. Its going to be hard to coordinate
it with York County Planning, to get the comments back in time. But
you’ve got a pretty good relationship, I do too, we can call them. The staff
could tell you what they’re recommending for information. I think
the planning commission meets on Thursday. Councilman Snyder asked

if we have to formally advertise and adopt before we send it on to them
or can we take this form as is, and make a motion to send it on to planning
to get their comments back before we even look at them. Solicitor
Solymos said I think they will give you informal insight and I think their
formal action via the MPC if you haven an ordinance that you want to
adopt it, has to be reviewed and you must receive comments from the
planning commission. Doesn’t mean you have to accept it. Councilman
Allar said if at all possible to keep with what we want is to get the
comment of the planning commission. Councilman Snyder said all I was
saying was can we move this along, make a motion , say send this right
to York County Planning and have their comments come back in January
and if in February we make a motion to accept their comments, make any
revisions, we’d have time to look at it and move on from there. Solicitor
Solymos said let me ask you something silly, it’s the middle of the winter,
are we anticipation any plans coming in that would require screening. Are
we doing this because we’re anticipation something coming in very
shortly? Mr. Reichard said I haven’t seen anything at the moment, but
we have no way of knowing that. Solicitor Solymos said well, so we
don’t, this is not done to protect something because there’s something
serious in the wind? Councilman Snyder said no, we just want to clean up
the borough ordinance. Solicitor Solymos said then I think we should just
start doing it and just do it in the normal course. Councilman Snyder said
okay, then at that point then. Solicitor Solymos said I can get it ready for
adoption. The secretary said, no, I don’t have a copy. Councilman
Snyder said if you want to make a copy then, make copies for everyone
on council and put it in their next packet and then they can have
comments, look over it for the next meeting and have comments ready
that we’ll discuss at the next meeting. Mr. Reichard said that’s not in
a formal ordinance. Councilman Snyder said no, at that point if
everyone is in agreement with it, then what we can do is make the motion
at the next meeting to have Pete run that into the formal ordinance form
and we’ll start the ball rolling that way. And if takes two months to get it
through planning, it takes two months. Councilman Noll asked if this is
at all in response to what was fought within the last two years in the
municipality? Are there things specifically to look at within zoning?
Councilman Snyder said there’s always things to look at in zoning.
Councilman Noll said there was land use issues on the number of
houses, lots and things like that. Councilman Snyder said it addresses.
Councilman Noll said those issues don’t come back to haunt everybody
since the period has expired. Mr. Reichard said the ordinance will soften
the impact of development of that nature. Councilman Noll said so it
possibly can back and the borough can say that everything in the
zoning must now be an acre or ½ acre per structure. Mr. Reichard said

they still have the right for that type of housing and the problem was
they originally had a two acre minimum tract in order to allow that
type of housing. Council considered increasing the size of that tract
to five acres. That would cause exclusionary zoning within the borough.
That would have prohibited that type of housing. So we want, we did
leave it at 2 acres and established these buffer zones basically 25 feet
wide that includes trees, shrubs, hedges within that, to protect lands of
recreation, health facilities, things of that nature, from high density
development or industrial uses. To proved an extra area that things are
offset from property along there. Councilman Snyder said so instead of
getting 4 buildings like he negated to, he may get 2. Mr. Reichard said
may get 2, may get 4, however there is a barrier. Really that’s an
option we had. Councilman Noll said what you’re saying is you can’t go
through all those for any land use in the borough that is in that type of
zone, you can only build that type of house. You can’t have any type
of high density housing. Councilman Snyder said that’s what we tried
to do and that’s why he said we can’t do. We can’t exclude out high
density housing. Which was what my original intent was, to say okay
for high density we need a minimum 2 acre lot, make it a five acre
lot unless somebody goes and busy a lot of houses together, you’ve not going to get 5 acres in Yoe Borough. And that’s when he said
then that’s when we are running into the problem of exclusionary, that
you’re not allowing for. So this way we’re still allowing for it, its
just that there’s extra protection there and by doing that, instead of him.
Like in that plan, that he presented he was able to get four structures in
There, because of these extra buffers, he may only be able to get three or
two depending on how it works out because you still have it. Mr.
Reichard said and the particular plan had infrastructure in it, of that
Nature, and because of the buffer area. Councilman Snyder said he
can’t run stuff in there now. So its going to make it more difficult to
get the amount. If he’d had put two buildings up there to begin with,
I don’t think we’d had near the contingency there. That was the intent
of this, that’s how its written again, come back with comments at
next month’s meeting and we’ll go from there. Solicitor Solymos aid
then I’ll put it into a format that you can adopt as an ordinance and
advertise for February. Councilman Snyder asked anything else for the
solicitor?

Billing Councilman Snyder said I will make another comment while the solicitor
Forwarding is here. We did receive his bill for the end of the year, all but December,
until November 30th. You will see it when you see, you won’t see it on
the bill list because we just got it tonight. There are issues in there with
the Cottrell hearing. We are suppose to be billing that back to our
insurance carrier. They said that they would take care of it. So unless the
solicitor tells us otherwise, we will be adding that to our bill list to pay
the full amount with the submission of those amounts, highlighted,
and sent to the carrier for reimbursement. So if you notice that on next
month’s bill list that’s how we’re planning on doing it. Councilman
Allar asked if you are billing the full fee? Solicitor Solymos said I don’t see any reason why we shouldn’t but unfortunately I am doing it for
you guys, they’ll pay that at that rate. Councilman Snyder said
unfortunately, he was working on our behalf not on theirs and I know
what you mean. Solicitor Solymos said that was a very bizarre. They had
asked me if I wanted to take it over on behalf of the municipality. I said
no, because I was a witness, anyway. Councilman Snyder said the same
way I brought that up, the same way with the zoning officer’s report,
his time on his bill that he spent with the trail and everything with the
hearing. I should say that’s on there, will be billed back. We’ll just hang
that up front, and getting reimbursed. So I just wanted everybody to know
if you see that on the bill list. The secretary asked for the definite address
to send the billing to. Solicitor Solymos said we have that and if you have
any problems getting that bill reimbursed from the carrier to let him know.
The secretary will send that out ASAP asking for payment. Councilman
Snyder said I don’t think they know they are getting the bill.

Holiday Councilman Snyder said on behalf of the council, thank you for another

And Thanks we will look forward to another year. Solicitor Solymos said you may say
Merry Christmas, I will not be offended. The secretary reminded Solicitor
Solymos that the next meeting is the first Monday of January for
reorganization. Solicitor Solymos said someone who represents the firm
will be here. I don’t remember whether I came to your reorg two years ago
or if I went to Hallam Borough’s. I don’t remember. The secretary gave
the solicitor the list of the 2008 meeting dates. Councilman Snyder said
we will let you know if there are any changes to those dates.

Main St. Mr. Shearer said we did receive plans for Main Street resurfacing slated
for 2008. With the overlay there, there will be a higher grade of mix,
76/22, which I think is like a polymer based asphalt. This is to get a
better skid resistance on the hill, better aggregate and polymer. So that’s
they’re answer to what they intend to do out here. They will be doing that
through the majority of the borough. That’s what they’re going to do.
Councilman Allar asked if its going through the entire borough area.
Councilman Snyder said from what I understand of the project its going
to start up here at Sheetz and go entirely though to the Tom’s in
Dallastown. Mr. Shearer said a portion of it, outside of town and stuff,
They will be using a standard super pave mix. John had requested, sent a
letter. He requested that I follow up about the milling because we
requested them to do something about the hill before they do this
project. I did call Terry Sprenkle again today, he was suppose to get back
to me. They still say yes, they are intending to mill. But I guess the
weather has kind of held them up. The reason they are looking at June for
the project, is because Dallastown has their work that needs to be done in
the spring also. Mayor Sanford said if he doesn’t come through with that
promise you’ll see another article in the paper. The new manager vowed
to make corrections in the county.

Roof Mr. Shearer said I did get a price from Nick Sabold, of Sabold
At Park Construction for the roof over the kitchen area at the park. The
estimate was $3924.00. That included to remove the roof over
the section of the kitchen back to the little valley there where the
main roof comes in. So take the chimney down at the end because
that is part of the problem. Because the flashing around there is
getting water around the chimney. The chimney no longer serves
a purpose there. And that the roof, its currently a thin roof, put the
pitch in it is so level that I guess that’s one of the biggest problems.
The eves and stuff filling up when there’s snow accumulation. The
water is laying there basically in those areas and causing the rot. What
he is proposing to do is to take the old roof off and remove the chimney,
replace rafters wherever needed to be replaced, and rebuild the deck
with plywood and a rubber roof on top of it. I didn’t know for sure
what we would be looking at there, it does fall under the $4,000.00. We
wouldn’t need to get any other bids. I don’t’ know if you want me to
get any other prices or if you want to push forward. If you are getting this
done anytime soon or if you’re going to corporate this into future work.
I do think we are getting some water in around that area. Councilman
Crull said everything you said sounded good until I heard plywood and
rubber, rubber over plywood. When I used that rubber roofing, they had

another material that I was to put over the plywood, now I don’t know
if they’ve changed that. That should be in your category. To put a rubber
roof over plywood when I did that over my own garage up on Elm St.
they told me not to put the rubber right over the plywood. They had like
a sheeting that had fiberboard that I had to put over the plywood at first
to make the rubber last a lot longer. Maybe you want to inquire into that
and make sure we’re going to get something that might last longer than
four to five years. That rubber roof I put in is about 15 years old already.
I did it the way that they told me to do it. Councilman Snyder said I just
heard an agreement with our borough engineer. I know we just discussed
last month about getting on board with this park project in February and
see if we can bring something together and get a plan together so we
can start working on that. Personally I would hat to put $4000.00 into
this, which can be part of that grant. Councilman Allar said I think that,
that is many many years away. Councilman Snyder said yeah but if we
get the plan together and get the thing approved then we know that
any money like this that we spend would at least go to matching funds.
I don’t have the problem of spending $4000.00 but a least then its
going towards matching funds. We can say, look I don’t care if this is
a year and half off but we’ll put $4000.00 on the park now but at least it
goes towards our matching funds. If we do it now. Councilman Allar said
but again you have the chicken or the egg, its hard to put a plan together
if we don’t know how much money we’re going to have. I know with
CDBG for example, that’s not going to be decided by February. I don’t
expect to hear from them as a matter of fact I was going to talk to
Jason about that. Somehow we got our priorities screwed up. So you
know, I would say its very doubtful that we’re going to have a plan
in February or March and then it takes I don’t know how long its going
to take for Harrisburg to make a decision on that. If this is from Dana’s
opinion that more damage is going to occur then maybe we’ll just have
to bite the bullet on it. Mayor Sanford asked if that can be patched
anyway, temporarily to get us over the winter. Just to keep water from
running in. Mr. Shearer said I could cement the heck out of it. I mean
the roofs are connected, cement everything up and see what happens.
I don’t really think we’re going to do much more damage. Except
maybe lose ceiling tiles from water coming in, I think the damage is
already done. Councilman Snyder said to the rafters and stuff. Mr.
Shearer said yeah, the damage is done. Councilman Noll said more
and likely the cement won’t do it. Mayor Sanford said maybe there
is some newer stuff out there. Councilman Allar asked if there are
any contractors out there particularly over the winter that would
contribute some labor for materials. There are contractors that help
out municipalities. We could make a contact and see what happens.

Mayor Sanford said I personally don’t know of any. Councilman
Allar said maybe any that work for the school district. Mayor
Sanford said nobody works for us for nothing. Councilman
Snyder said number one, its not budgeted for, for next year, we
would have to take it out of capital reserve if we did it. Number two,
I know what you just said about the DCNR grant, the problem and
I don’t want to start a big debate here. I want to keep things moving.
But I will say, the clock is ticking on the DCNR grant. We’re
already 2 to 3 years into it. Councilman Allar said we have until the
end of 09. Councilman Snyder said at the end of 09, we know we have
$70,000.00. We don’t know when that other money is going to come
In. If we start working and plan in February/March and we proceed with
only the $70,000.00 and we try to com up with how we’re going to
come up with matching funds to get as much done as what we can. And if
the only thing we can do is tear that building down and build a new one.
Tear down that and the bathrooms, build one new building. How much is
a new building going to cost, $40,000.00, $50,000.00? That can be the
plan and make it ADA accessible. Its not like a whole lot has to be
in there. The point is we know we have $70,000.00. We keep putting this
off and the building is getting worse and worse. At the same point, I hate
to spend the $4000.00 when that could go towards our matching funds.
Food for thought. But as far as right now, I guess it’s the consensus of
Council that it’s a dead issue at this point. Because we at least know
based on the consensus with the engineer that its not viable to put
the rubber roof like Ron said right over that so. Mr. Baade said there’s
another issue, that’s in the middle of trees, correct? Trees and rubber
roofs don’t get along very well. Branches fall off and then you can have
a hole right through the rubber roof. Mr. Shearer said that’s true too.
Councilman Snyder said so rubber may not be the way to go. Once you’re
thinking of putting that on, you might as well put on a 20, 25 year shingle.
Mr. Baade said then there’s no ice dammed up underneath the shingle.
Mr. Shearer said, to me I think the fix would be if we get a good foot print
of the building at that end, we should look at repitching that area so that
it has a steeper slope. Councilman Snyder said oh yeah, and we may find
once we get into this plan that’s why we need to get the engineer involved,
we know we have $70,000.00 to work with, we just have to figure out
where the matching funds are coming from. But we know we have that
$70,000.00 to work with. It may be cheaper to tear that down and the
existing bathroom, rebuild it new and combine everything into one
building for $70,000.00. Mr. Baade said you’d have to get it up to a
3 12 pitch. Councilman Noll said we have an education center that’s done
projects like this and if you’d like I can take a look at it and possible get

the work done for nothing. Councilman Allar said, I said about
Vo-Tech, Vo-Tech does these projects also. Councilman Snyder
said that’s what I’m saying we know we have $70,000.00, our
issue is where are we coming up with the matching money. We
may not find out, I know you had a meeting with Mike Waugh,
but they’re not going to be able to give us definites and even
when the money comes in until the end of the fiscal year, which
is June. I mean we keep putting this off and I’m thinking we’d
better start making a decision to go with what we know we have,
if more money comes in that’s great. But just like Seth just said,
there’s this opportunity for in kind contributions. You’ve already
talked to Jeff with his contribution on some engineering. Barry
knows about Vo-Tech. Okay I’m hearing about all these in kind
contributions and we’re sitting on this $70,000.00. Its like I don’t want to be putting $4000.00 into a roof if the engineer comes back
and say in the play is, tear down the two buildings its cheaper to
build new one that’s ADA accessible than it is to revamp one. That’s
all I’m saying and that’s why I think we need to start keeping on the
ball, keep on the radar. Because yeah the building is getting worse.
Councilman Noll said at this point, I do estimates, at least have that
Amount. Throw some money at the project to see what we’re looking
at. Councilman Snyder asked is it worth doing now or do we need
to do. Mr. Reichard said like Tom said, the plan is going to take
awhile to develop but if you are concerned about the building falling
down. At this point it makes sense to put $4000.00 in the building that
includes if we do the renovations at the park in the grand scheme of
things. Councilman Allar said what I’m saying, Vo-Tech and some other
entities is willing to fix the roof, it’s a done deal. It may be temporary,
at least its done for the immediate. Then we don’t have to rush this plan.
I think having a handle on the money makes more sense that getting
The plan. The money is going to dictate what the plan is going to be.
I don’t what to anger the people at DCNR by making 52 different
changes as more money comes in via the grants, that we may get,
maybe we’re not going to get them. And then go back and forth and
readjust the plan. Mr. Reichard said we can build a plan with just that
money, we know we have $70,000.00. We can shoot for the other
$70,000.00 to match it so we’d have $140,000.00 for the plan.
Councilman Noll said if you want a design on the building , I can do
it for nothing and give you an idea of what its going to cost. Councilman
Snyder said well work that up, I mean if you can work that up and say
what it would cost to put in bathrooms and a building that has capability
in there,and what it would cost to tear down. Councilman Noll said

for the $70,000.00. Councilman Snyder said I have no idea what it will
cost, I have no idea. You see, who knows. Then we have more of an
idea which way we would want to go. That’s not saying we can’t
renovate what’s up there. Councilman Noll said I can stop u there
and take a look. Councilman Snyder said at least for tonight’s issue that
no action will be taken on the $3900.00 for the roof until we have more
information.

Trees Mr. Shearer said also on the park, I had a meeting with Matthew Kern,
At a forester with DCNR. I was trying to get some information on what they
Park call urban forests. We know we don’t have a very large tract, we do
fall into urban forest area. The state has some initiatives to try to maintain
patches with trees. So he is trying to see if he can get, what help he may
be able to get as far as additional trees, cheaply to plant. There are some
from the Bureau of Forestry. Also the Conservation District is having a
planning sale coming up in the spring also where we might be able to get
material from, it would probably be a couple hundred dollars to get some
trees. One of the areas that I would really like to plant is the area over
looking the tennis/basketball courts, that hillside that adjoins Rexroth’s
property. Basically my concern there, that we’re tearing the ground up,
there’s some patches there with pretty dead soil. I’d like to see to maybe
put some plantings on there to save a lot of the bank. Add some smaller
trees around the building area not directly at the building because we
don’t know what we’re going to do yet. Just try to maintain the health
and maybe add some new growth. He hasn’t gotten back to us yet, we’ll
see what he gets.


Small Mr. Shearer said just on a limb here, the last thing you see below is
Wind small wind turbines. I don’t know if it will even benefit us but I had a
Turbines brainstorm onetime, that the wind blows pretty good here and up at
the park. I did run across at the PSAB website, where the Borough of
Minersville got some money from DCNR for small wind turbines from
a private organization, basically they installed them. They use it to
offset their electrical consumption at their pool area. There more hilly
than we are, Schuykill County. But if its something we can get free
money for, do we want to see if we can do something to see. There
small, basically a couple mega-watt wind turbines and see if we can
offset some of our utility costs at the park and here. And if we could
sell it back to the utility company and that would offset our utility
bill. Try to make us a little bit more greener. Councilman Snyder asked

if you want a motion to proceed with that? Mr. Shearer said yeah,if you’d
like, basically I’d like to keep it real informal, no expense. I don’t know if
its something that is going to be billable. I’d let you know. Councilman
Snyder said I don’t think you need a formal motion, I think you have the
consensus of council to proceed with that. And on behalf of council I want
to thank you for your innovation idea. Good luck on it. I give you kudos
for that. I never ever even saw that thing. Sounds like a good idea and if
it works, great. Mr. Baade said to take a look at Northern Hydraulics
catalog. Mr. Shearer said that’s where I actually saw them for sale
originally. I kind of got the idea from that. I thought it might be something
we could get grant money for. I just happened to stumble upon the
article about Minersville. Councilman Snyder said well again, we
appreciate your innovative thinking there, that’s what we need to do.
Councilman Allar said there are firms out there that might do it for
free to get their prototype out there and get advertising.

Selective Councilman Snyder said I just had one question while you were looking
Wildlife at tree conservation up at the park and you had that meeting with the
Control forest. Has anything been mentioned about selective wildlife control?
You and I had discussed it as far as what may be there to help to maintain
our trees. Mr. Shearer said actually I did approach that subject with him.
Councilman Snyder said anything to save the trees.

Notify The secretary said I wanted to let you know that when Gail Koller is
Gail sent the contracts to send out for 2008 that she will be notified that
Koller if we do improvements at the park in 2009 that there could be
cancellations for the reservations she takes in 2008. I just wanted
you to know that she will be informed that the council is starting to
think about improvement/changes up there. Councilman Snyder said
we almost need to because at this point we don’t know how this is going
to go. The secretary said you and I had discussed this and there are
people who automatically book their date this year for next year and they
need to know that possibly this could affect their rental. Rentals occur
between May and October. So it may hit the time when we are renovating,
we just don’t know.

Four Councilman Allar said last month I mentioned about the four wheel drive
Wheel mower that North York was selling. In the meantime, Red Lion has bought
Drive it. Stew Graybill said he is willing to let us use it at not cost for like two
Mower days a week which is more that enough to cut the basin and use it in the
borough as well. So the first step and Dana and I talked about it, have

Dana, Barry and maybe George take a look at it and make sure it can be
Done And at that point, I told Stew that I’m not willing to burn bridges
with the township and tell them that we don’t need them unless we get
something in writing. I want a written commitment for those two days
a week. He said again, no problem. Dana and Brett can get together.
Again just a recap, there are three advantages here, one, if we cut
the grass, we avoid a $3500.00 to $4000.00 bill from the township even
though its divided among the two other municipalities, its still our biggest
cost that we have in maintenance; two, we can now bill Dana hours, his
hours now go in and we get the money back; three, we have a mower we
can use, and Dana can talk more about this, we don’t have to buy mowing
equipment now. To be fair, I would want an agreement that we would
share 50% of the maintenance costs, things like that. So that’s where we
are at, I’ll wait until I hear you’ve looked at it. Councilman Snyder said
the only thing I’d add to that before we actually get into maintaining or
mowing at the dam, is to check as you said we don’t want to burn bridges
with the township, is to check with them and make sure what agreement
that they may have with the people that are currently doing the mowing. And if they have like a two year, three year contract and how that may
affect that. I don’t know what they have. Councilman Allar said I gave
Scott Depoe, a bit of a heads up and that did not come up. Councilman
Snyder asked that they did have a contract? Councilman Snyder said
nothing, I didn’t ask him point blank on that questions as to that.
Councilman Snyder said we just want to make sure that isn’t going to
affect anything there.

Engineer’s Report

Update Mr. Reichard said I actually don’t have a whole lot to go over. Most of
On Dam it is going to be an update for the dams. I talked to York County
Project Planning Commission and they told me they received the commitment
letter from Red Lion Borough, that was still outstanding and they indeed
received it, in the amount of $10,000.00 which is good news. They also
contacted me to try to find out the status of the state funding. We have
not received an approval letter or a denial letter. So I contacted DEP
directly, got right to the department manager for the grant program
and basically hit a wall. She wasn’t willing to give me very much
information. I did find out some reason why. They said our application
was received and they said it was reviewed and it was scored. All the
applications were forwarded to their executive office for final approval.
And that is had been there for some time.

Zoning Mr. Reichard said I made a couple of copes of the zoning ordinance
Ord. amendment. I apologize for not making more. I will make more copies.
Amend. The secretary said I’ll make the copies, I was instructed to make them
to include them with the packet for the January 7 meeting.

Final Mr. Reichard said we came out today and met with Dana and went
Dam through the dams and took pictures to submit with the inspection
Inspect. report for DEP.

Final Councilman Snyder said for the engineer, we did receive a notice
Inspection from York County Conservation District that the final inspections
John were done for the John Adams subdivision. Guess everything
Adams looked good there. Councilman Crull said I want to comment on
Sub. that, the pond that’s over there. Jeffrey Firestone’s name is on the
paper. Find out when they’re going to close that thing up over there since
I called before. He had promised me that by June it would be totally
closed up and seeded and so forth. I’d like that in the record. The
secretary asked if it was Jeffrey Firestone that you spoke with.
Councilman Crull said let me check my paper. Councilman Snyder
said that was the responsible party. Mr. Reichard said that was a final
inspection that wasn’t to close out a pond. Councilman Crull said I
thought it was Firestone. The secretary said Jeffery Firestone is who
the document is addressed to. Councilman Snyder said let the record
reflect that Jason has just pointed that, that’s just a final inspection
not the close out on the permit. So there’s still recourse there before
they close out the permit. So that should help you there, Ron. He said
to make note that its just the final inspection, not the close out of the
permit so we still have recourse before they close out the permit.
The secretary asked if we will receive notification like that, Jason, for
the close out of the permit. Mr. Reichard said this is the final inspection
what they’re doing, they’re requesting a notice of termination to be
completed. Another for is filled out and submitted for approval to
terminate the NPDES permit so. That process is on the way. They’re
telling you by June, I’m getting the impression that they’re trying to
get out of this now. Councilman Snyder said do you want to make
contact with them now, to say this is still an issue before they close
this out. The engineer then is going to make contact to the County
Conservation District to make sure they’re aware that the issue
that Ron brought up is taken care of before the termination of the
permit is complete.

YCPC Councilman Snyder said we also received notification from York
Notify County Planning for the 2008 action plan for CDBG,Home and
ESG program and their executive summary. I looked over that and
Yoe Borough is still on the short list for 2006-2008, three year
funding on CDBG for the Mill Creek Stream Bank stabilization
project. Councilman Allar said that’s what I was going to bring up.
Jason, my recollection is that you sent them a letter changing priorities.
Mr. Reichard said yeah. Councilman Allar sad this is going to hurt,
I’ll call Felicia Dell, tomorrow. Mr. Reichard said Joiann. Councilman
Allar said but Felicia is over Joiann and I mean I’ll call them both.
Mr. Reichard said I’d speak with Joiann because she is with the CDBG
program. Councilman Allar said well I had talked to Felicia Dell about
making sure that we have the priority changed and asked her to confirm
that she had a letter and she did. So I don’t know, I don’t know how
that can get screwed up. Mr. Reichard said I don’t believe there was
ever action taken in it. I know there was a letter basically requesting
that the park job be considered. I don’t remember the exact language
and I know there was a conversation with Joiann and for some reason
she wasn’t making that official. I’m not sure if she wanted another
application submitted, request or not. I don’t know, I have to ask.
Councilman Allar asked do we have to do this over, another
submission for next year? Mr. Reichard said I don’t know, I’d find
out. Councilman Allar said I’d call. Councilman Snyder said it maybe
still going on the fact that when submitted to CDBG, council had ranked
the projects and we had ranked that as #1 because we were following.
Councilman Allar said that’s what I’m saying, we changed the priorities
and changed it officially via a letter. Councilman Snyder said the
council didn’t. Councilman Allar said what? Councilman Snyder said
council didn’t, that’s the thing. Councilman Allar said Jason was speaking
for the council. Mr. Reichard said the letter would have been written on
behalf of borough council. I can’t remember why nothing happened.
Councilman Allar said I’ll check on it and see what’s going on.
The secretary asked if that is for work that’s going to be done through
the end of 2008? Councilman Snyder said yes. The secretary asked
when do you apply for the next three year cycle? Mr. Reichard said I think
this puts us on notice now I haven’t seen the letter. Councilman Snyder
said it just says this is the action plan, detailed information on projects and
activities proposed in 2008 which covers program years 2005 to 2009. Mr.
Reichard said in 2009 they should be sending it out. The secretary asked
if it starts up on January 1, 2009 through 2010 and 2011, do you apply in
2008 for 2009? Mr. Reichard said you apply a year in advance. The
secretary said we should soon be applying for the next three cycle.
Mr. Reichard said they’ll send you a letter. The secretary said then I send

you a copy? Mr. Reichard said we usually receive a copy too. Joiann
talked to me and that they were starting to get their paperwork
together. The secretary said this notice was telling us what has to be done
in 2008 and the way it looked through 2008. It didn’t look like an
application. We will be getting something in 2008 to apply for 2009,
2010 and 2011. Mr. Reichard said that is correct. I usually receive a copy
Too.

Minutes Councilman Snyder said the other thing I have for the engineer and we
YBSA did get the minutes from the September 13th sewer authority meeting.
Again I’m making the engineer and council aware of this because the
clock is ticking and eventually we’re going to get this baby back. I
don’t want it anytime soon, Rodney. Mr. Smith said I think its next
year. Councilman Snyder said I will point it out under the engineer’s
report just tow things to make council aware of in that report. They did
address the one sump pump on Main Street they need more wet
weather to continue that investigation. In the EDU’s, the year of
2003, was a wet year and this year has been dry and in the spring when
the Chapter 94 report comes out, they will be dropping off 2003 which
is giving up a fairly good outlook for next year’s EDU’s. The rest
of the stuff you can look at in the circulate file or something, more or
less.

Subdivision Councilman Snyder said we did receive the latest 2007-08 billing
Rates 07-08 rates from C. S. Davidson which I will take home and incorporate
into the resolution for January’s update of subdivision approval
rates. I guess that’s the best way to say that resolution. I hope
we don’t have any that we have to use it but in the event that we
do. Anything else for the engineer?

Greetings Councilman Snyder said if not, on behalf of council I’d like to

Mr. Baade said I don’t really have a lot. The only thing I can tell is the
Wrap Up property owned by Cottrell has apparently been rented, one of his
Properties. They applied for a sign of which we granted a zoning
permit. Turned it over to Dana. He said as soon as the sign goes up
he’s going to hit them with the rental charge. That’s the only
issue on that property. 53 N. Church Street, we have an uninspected
car that comes and goes. There’s nothing I can do with that. If I
catch then while its there. I did catch them one time. If I file now,
it will get thrown out cause I won’t be the zoning officer. So why
file, just keep an eye on that one. Those are the only two things.
Its been fun working with you over the last few years. If your
arrangement with Red Lion doesn’t work out, want me back,
give me a call, if I can, I will. It’s been a pleasure and hopefully
I’ve done good things. I think I have. I wish you all a very

Nov. 14 ,2007 Mr. Smith said on the fourteenth of last month I attended a meeting
Meeting up at Emigsville. It was a rather good productive meeting. They had
about twenty different agencies from around the county there that
rely on different services for the county or whatever. They gave a new
sheet that thye made up for people who have special needs, whatever
their health conditions may be, emergency contacts, primary care
physicians. They would like it filled out and then it would be recorded
on the new CAD system. If an emergency call would come in or an
emergency evacuation they could tell right up front, what they might
need. I don’t know if we could send them out. Probably send them out
with stamped return envelopes, to get them back because people
wouldn’t want to spend money, just take the time to fill it out. They
had a lot of literature there. I brought some of it along. The different
things from the bus company. One good thing, they have a big pill
bottle and it has all the information in there, two stickers, one you put on the front door or wherever you come into and another one on
your refrigerator and they recommend that you keep it in your
refrigerator. And that would have, if we would go into the house, we’d
see that and we would know they need a special medication under special
needs. And we could go right to their refrigerator wherever that’s marked

at and they recommend their refrigerators, everybody puts them in
there. They have a light file. Mayor Sanford said they use to do that
year’s ago, its called the file of light. Mr. Smith said they’re coming
back to that again. They also have a file folder from the County Area
of Aging, to put in it with all your records and put all your insurance
policies, important papers, because of incidents that are happening of you can go there and pull this envelope and could leave one of the, what
a guest doctor there, who has been going around to quite a few of
the emergencies we’ve been having. She was down in New Orleans,
the last one was in New Jersey where they had the flash flood. And all
the people that’s getting displaced, she found the ones that they’re
having that most problems with is the people that are older people and
they don’t’ have any family. One of the questions she asked, when she
was doing her interview, she asked this lady that they had to evacuate
form the second floor of her house. Why didn’t you leave your place
when it was first announced for evacuation? She said well, I saw
the water coming up, I closed my blinds and went to bed. She said
in closing up all their care centers, there are the people that they’re
having problems with, the older people. They don’t understand whats
going on, no place to go and nobody to look after them. She usually,
that’s the problem in every place that she has been throughout the
country. She goes around to do the evaluation. She is a psychologist
at the York Hospital but she also volunteers for the Red Cross of
York County. These file folders are very nice. I’m going to call
and see if I can get more of them. They had the people there from
the bus company. The representatives said whenever we need
buses give them a call. They do go out and answer a lot of calls
for the fire department in the winter especially, to keep the
people warm. They have it for whatever needed, special needs, you
may have for wheelchairs and stuff. We have to let them know. They had
several youth groups there that take of children and youth. York County
has one of the first recovery centers for protection of animals. They
have several places, one of them would be at the fairgrounds. Take care
of any type of animal.Also another place. The problem in evacuating
people from these different incidents, people didn’t want to leave and
leave their animals there. York County has put it together to take care
of animals and all. That’s about it. Councilman Snyder said I just
have one question as you’re getting all this information, now I assume
if we had to have an evacuation here in town, its going to be more
widespread than just here in the borough. But are you keeping a list
of resources like that available at your end for Yoe Borough. Or are
you relying that the county, you’re just bringing this here for our

information and the county’s keeping this. That they have
a database that if we say Yoe Borough needs buses, like
you just brought up, you have a place to go to and they say
this is who you need. Mr. Smith said we went with the county
plan that we can just contact them. Mayor Sanford said the
municipality could opt to go with the county plan. Councilman
Snyder said so they’re basically our resource center. Mayor
Sanford said if we have a situation, the first call would more or less
be to the county. Councilman Snyder said I was just wondering how
much of this Rodney needs to be keeping on file. And just who is
keeping it. Its good information. I just want to make sure that the
people who have it, need it, if the time ever comes. Mr. Smith said
on these forms, the county would like all the information, have it
input. It would be all confidential. Councilman Snyder asked if
that would be sent to the county? Mr. Smith said yes. Councilman
Snyder asked who gave you this? Mr. Smith said York County
EMA. Councilman Snyder said again, I’m looking at this
and this is good information and how do you get the information
out to the people and get them to do it, you’ve got to make it easy
for them. Even if we can say, this is in a PDF file, we could put it as
a link on the borough website. I mean we could photo copy something
like this and come down and pick one up. Mr. Crull said I think the
only way you’re going to get the majority of the, citizens, is if you
talk to the landlords, they’re going to know if they have special
needs people. Up on Philadelphia Street, I think there is a fellow that’s
severely handicapped in one of those apartments. Councilman Snyder
said we do this every year. I’ll put a note in the paper and say that the
EMA requested that any resident with special needs contact them. How
many people do you get? I think we use to have like three or four. I know
that there’s more than three or four in town. Mr. Smith said most of those,
I went around to the two that I knew of. The secretary suggested that you
could send that out when you send out your property rental letters to the
landlords. Mrs. Crull said I think it would be more of a help from the
landlords. Councilman Snyder said how do you get the people to give
` the information. I mean, the old gentleman across from Philadelphia
Street, the ambulance was there a couple of weeks ago. He is not doing
good. And I guarantee you, he doesn’t have anything like this filled out.
I mean its not like you can force the people to fill it out. If they don’t see
This, I mean I’ll put a thing in the paper but if they don’t see it. How
many people did you get calls from when we raised their garbage fee?
Well I didn’t know about it, I didn’t see it. I mean what’s a good way
to get this information out? Short of asking the ambulance, everytime
you respond to an individual, leave one of these with a family member.

Say, please fill this out. I don’t know if that’s something we could ask
them to do or not. They’re not thinking of that, they’re thinking of
the emergency. Mayor Sanford said they would do that, I don’t know
how they would hand that on the scene, but I’m sure they would follow
up after they’re done doing their report. Probably make that out. I could
follow up on that. Mr. Smith said with the ambulance service, we use to
got a letter from the hospital, if one had a baby, special needs baby.
Mayor Sanford said they still do that, either the hospital or the service.
Mr. Smith said they’d notify the ambulance service that if something
comes up automatic with their new computer system, they would give
that information, time and location in the house. Councilman Snyder said
I wonder what the smallest amount is to get a homeland security grant?
Could you get one for $500.00, or $1000.00 grant to say we want to
send this out to every resident with a self addressed stamped
envelope with a letter explaining what it is, that it is kept confidential
and why we need it. And see if we get people to send it back. Even if its
I don’t know, its good information. I’m sitting here thinking maybe its
something for next year. Mayor Sanford said maybe we can get the
Boy or Girl Scouts. Councilman Allar said what about the fire company,
send some kind of notice via maybe newsletter? Mayor Sanford said
that comes out of our marketing company, they go by zip codes.
Councilman Crull asked when is our next newsletter going out,
wouldn’t that be an item that should be in the newsletter then send
these afterwards. Mayor Sanford said we have put it in the newsletter
before. Councilman Snyder said we did put it in the newsletter but we
don’t get any response. Now we have an actual form, at that point
we were saying, notify Rodney, I think we published his phone
number and said give him a call if you have a special needs. This is an
actual form for them to fill out. The secretary said we are going to be
sending the property maintenance forms out in February, we can
start with the landlords and send a copy of that along with it. I know
someone who lives in the borough who will get a copy. Councilman
Noll suggested door to door contact, even verbally, if not you’re
going to be a lot of money. Councilman Allar asked if it could be
sent with the tax bills? Mr. Smith said I talked to Patty last night to
put it in the newsletter. Councilman Allar said you’re going to get
the landlord what about the homeowner. Mr. Smith said you’re going
to have to send a return envelope with it. Several other municipalities,
like Dallastown, said they get very few back. York Township talked
about it. Councilman Snyder said I don’t want to beat his to a dead
horse, I’ll tell you what, I’ll put it in the newspaper like I always do.

get with John. In the meantime if we’re thinking about these
Boys and Girls Scouts, I’m looking at Dana. I’m seeing it’s a slow
time of the year being in the winter and I’m thinking the ARD would
be a prime group of people to say go around door to door and
slip them in the doors and if we have a cover letter with it, or
juvenile probation. Let’s face it, you’re not using them for mowing
and all the normal stuff, painting curbs and things like that. Mr. Shearer
said I wont’ have them back until spring. Councilman Snyder said
I’m sure if you said you have a special project. Councilman Allar asked
what is wrong with sending it with the tax bills? We’re already paying
for the postage, there’s no extra cost. They’re already going out its
going to hit about 95% of the people in town. Councilman Snyder said
probably not that many because if you have a mortgage, it goes right
to the mortgage company. Councilman Allar said its going to hit the
landlords by some other means. Councilman Snyder said and maybe if we
did that that’s something for ARD. There because an issue, I think the
tax bills are manually stuffed. You still stuff them? Mrs. Crull said yes.
Councilman Snyder said you wouldn’t get ARD people to stuff them,
tax bills. Mrs. Crull said no. Councilman Allar said I was thinking if you
want to do it sooner, that’s all. Like Dana said ARD won’t be around.
Councilman Snyder said I’m sure if he called there and said there is a
special project. There we just have to make sure we do it right, that we
don’t put them in mailboxes, literally open the door, shove them in the
door, buy some tape, and tape them unto the front doors. Someone’s
going to see it. Mr. Shearer said that can go the wrong way too.
Councilman Howett said the biggest problem is that people just don’t
care, that’s the bottom line. You can beat yourself to death with this. Even send, personally people, they’re not going to send them back
because number one, they don’t care and number two, they don’t feel
anything is going to happen. People are so complacent about it.
Councilman Allar said there’s only so much you can do. Councilman
Howett said thery just feel that its not going to happen here, its never
going to happen here. The secretary said when you put it in the
newspaper, you can see how much response you get until next month.
I think it’s a good idea to put it in along with the property maintenance
letters. I’m already putting a stamp on it, just put a little blurb, keep
this in your file with your property maintenance license, and when
needed sent it to us. They have to send us tenant changes. Stick it in
the envelope with the tenant changes. And I know one person that I’ll
send it to right now. Councilman Snyder said just to think about it.
These forms are they sent to the county or what? Mr. Smith said they get
sent back to me. Mayor Sanford said we should have a copy, we have

an EMA file here. Councilman Snyder said keep a copy at the borough.
Mayor Sanford will make additional copies. Councilman Snyder said
I just want everyone to realize if God forbid if we have a disaster.
I want us to feel comfortable that at least we did everything we could
on our part. Mr. Smith said its not only for disaster. Councilman
Snyder said for an ambulance all, a fire, they need to know. It was
funny because it just came up, Pete and I were talking about this today.
The fire company was concerned, talking about special needs. They found
out that there was a person in Hallam that was raising cobras. And they
wanted to know how they could regulate these exotic animals because
they’re lethal. I mean it would be nice to know if you have a lethal
animal in your house. Mayor Sanford said that’s why I drive the truck.
Councilman Snyder said I mean this isn’t asking if you have any lethal
Animals in there but its anything like that. It could be for a fire. One time
they were asking do you have any other thing in your house, like large
amounts of ammunition, I have about four pounds of flat powder up in
my back room. They’re probably like to know that, so if they’re going
to go in there for a fire, they’re not going anywhere in the back room
There’s double f, triple f. Councilman Snyder asked that one copy be
sent to the Red Lion Senior Center and let them know that more copies
are available at the borough office. Councilman Allar said you’re
talking emergencies, say something that could happen in the borough
where a parked chlorine truck gets hit by SUV and starts leaking,
does the fire company have any procedure here. They have
certain people designated to go out. I know they county has to
be involved. Mayor Sanford asked for a mass evacuation? Just
drive the truck and make announcements. Councilman Allar asked
if people are designated, instead of one truck. Mayor Sanford said
we take them all out. Councilman Allar asked and you have a way
like in a half hour to cover every place in town? Mr. Smith said the
one thing we don’t have in town is the civil defense siren, its out
of service for two years now. Councilman Snyder said one thing I
know driving Santa around, I think everyone knew Santa came to
town. So I think going around with a bull horn on the trucks works.
People who were in town could hear it. People who would be out
of town would hear it in the news quickly. That would make every
radio. Councilman Allar said they may not be watching. I think
the truck and bull horn is the only way to go. Mayor Sanford said
we would cover all the areas. Councilman Snyder said people
who aren’t in town, wouldn’t be able to get back into town. If
I’m at work, I just wouldn’t be able to get into town. Councilman
Allar said that would be good, with all the vehicles.

Councilman Snyder said oh yeah. Mr. Smith said I have that in
the plan. Councilman Noll suggested that we could amend the
rental ordinance to have this information upon inspection. That
you have it all down. Councilman Snyder said we need to update
that anyways, we had discussed having to redo that ordinance to
capture properties who are saying they are not rented. Basically
it would be any property that’s not owner occupied. We have an
instance, I’ll use Ron as an example. He owns the property or he use
to own the property on Elm Street where Deb lives. So he can tell us that
he’s not renting because its his daughter but we don’t know that for a fact.
He maybe renting that, its all under the table. So the idea is, if that
property would be in his name, and he’s not living there its going
to be deemed a rental property for the use of the ordinance. And that way
we don’t like Cottrell down here, we know he’s renting but we can’t
prove he’s renting and that will take that out of the equation. And that’s
one of those things even thought they’re not getting compensated for
it, that means en facto they are renting it, they’re just not getting
compensated and you want to do the same thing as you do for the
rental property. So it was just a little blurb that we wanted to change in it.
We could change that at the same time, that they have to pass one of
these unto their tenants once a year. Okay anything else of EMA?
Councilman Crull said I got your idea, but my daughter’s name is on that
property also. Councilman Snyder said yeah. Councilman Crull said
before that rumor gets around, renting of that place. Councilman Snyder
said I was just saying you as an example, cause it was easy to come up
with. Now you’re going to be able to swear to that. Councilman Crull
said you can check the records at the court house. Councilman Snyder said
just kidding.

Mayor and Police Report

Juvenile Mayor Sanford said correspondence, I’ll hand that to you with the offer
Probation for help if interested. I sit on a committee at school, with this young
lady that oversees juvenile probation, they are also looking for avenues
for work for the kids for public service, like first offenders. And there’s
stuff in the borough, that we could do. I’ll pass this around. Councilman
Snyder said to be totally honest, I’ll officially pass this on to Dana. If
You have some down time or something, read over what they do as
far as what they offer and see if you see a need there, if we can use them.
Mr. Shearer said maybe they’ll show up more than the adults. The adults

don’t like to come here and work. Mayor Sanford said
the part time staff can’t do this. Councilman Snyder said
I am familiar with the program and I know that they expunged
people’s records if they do it, its for nonviolent first time
offenders. And most of the time, well its not expunged, they
never follow through with the charges, so the charges are dropped.
Mayor Sanford said we do that a lot up at the school. Councilman
Snyder said they’re more apt to actually do something. Now what
they can provide or what their criteria is, I don’t know but I think
Dana is a better handle whether. Mayor Sanford said its
pretty broad. Councilman Snyder said I don’t know because of
hours, if it has to be on weekends versus weekdays. Look over it.

Oct. Mayor Sanford said York Area Regional Police reported the following
Police for October 2007: 46 calls, 2 accidents, 3 accidents with injuries, 14
Report traffic citations, 2 summary citations, 4 misdemeanor felony arrests,
2 juvenile arrests. Service hours for the month of October are 58 hours
and administrative hours 32.70 hours. Reading in the minutes, there
was a question how the numbers, that the numbers did not add up.
They do add up, if you look at the report, there’s type 1 calls, type 2
calls and general miscellaneous and those three I add up to
get my total calls. So they do actually add up across. Type 1 are
and I ‘d have to get a breakdown which I can, I think type 1 are
very serious calls like rapes and things like that. The lesser are
type 2 and goes down from there, like barking dogs, parking and
stuff like that.

Police Also relating back to last month’s minutes, I will start my term
Commissioner as the newest police commissioner for the regional force at the
beginning of January. I do sit in for the alternate. There’s two
commissioners for York Township, two commissioners for
Windsor Township and a citizen at large from one of the other
municipalities. I sit in and have a voting right if that citizen at
large is not present, which in November, he was not present.
But that sixth commissioner does get a voice in all the discussion
and becomes part of the executive session. Councilman Allar
asked if its just the citizen at large, its not for the others? Mayor
Sanford said no, its just for the citizen at larger when they are
Absent. Councilman Allar asked if the alternate ever voted?
Mayor Sanford said yes, last month in November. It doesn’t
go on a lot, a couple of times a year. Councilman Allar asked
if your term is a year? Mayor Sanford said yes. Councilman

Snyder said at least you get to sit in on the discussion of the
executive session. And you’ll get into the contract negotiation.
Mayor Sanford said I’m hoping they get that settled before I
take office. I really hope for that. Councilman Snyder said then
you’d be going to a lot of executive meetings.

Weight Mayor Sanford said there was a traffic citation issued dealing with
Restriction weight restriction. It was issued on Elm Street about forty five days
Citation ago. The fine was very expensive. It was on a tractor trailer, the
tractor trailer was empty .They went by what was wrote as, the
total gross weight of the vehicle, the fine was based on the total
gross weight of that tractor trailer, which was thousands and
thousands of dollars. We are waiting for word to see when that
is paid. So that will be the first citation that I’m aware of. Councilman
Allar asked that they came upon it themselves? Mayor Sanford said
Yes, they just happened to drive up on them. Actually it was heading
back by Orchard, toward the House of Windsor in that direction.
Right place, right time. Officer Zech was the one that happened to be
at the right place at the right time.
Arrest There was also an arrest at the ballpark on Sunday afternoon. I came
At Ballpark in to check for mail and I observed a vehicle sitting at the ball park.
Something just didn’t look right. So I watched them through the
garage window, things progressed downhill so I had a car come in.
The driver was arrested for two outstanding warrants in the city.
Councilman Allar asked what was he doing? Mayor Sanford said
sexual activities plus littering. Mrs. Crull said she saw the vehicle when
they got home. Mayor Sanford said if you see it again, call it in. They’re
ban from this area forever.

Street Cut Mayor Sanford said I have a question on the street cut that was made
? in conjunction with the fire hydrant on George and Main Streets. Is
that going to be fixed any better? Mr. Shearer said yes, they will get
that when the weather improves about six months until it settles out.
Mayor Sanford asked that’s not going to be a problem with a plow?
Mr. Shearer said it may be a little but the state takes care of that.
While you are on the subject, Sandy will probably elaborate later but
its been billed, Sandy got the check for the initial bill and they were
notified that we will be additionally billing for the sidewalk and street.
Mayor Sanford asked are you keeping an eye on the sidewalk as it sinks,
that it doesn’t become a trip, fall hazard? Mr. Shearer said hopefully
we’ll be able to get Restuccia in there when we get some nice weather
so it can be fixed.

1st Snow Mayor Sanford said it was kind of ironic that when we had the first
Storm snow storm after we had all the big thinkers in town, we got part
time people, we had our p’s and q’s. All the part time people were
away. You were away? Mr. Shearer said no, I was here plugging away.

Training Mayor Sanford said for our newest council person, there’s some new
borough official training that we can forward to you. Unforunately
the two closest are in Adams County and one in Harrisburg.
We’ll get you information on that.

Invite Mayor Sanford said I wanted to ask, did we ever get an invitation to that
Sept. 20th from anybody? Councilman Snyder said not that I know of. I wanted to
ask you about it. Mayor Sanford said this is the kind of stuff, we should be
asking about. Councilman Snyder said and considering they were there.
I was just going to bring that up for your benefit. Mayor Sanford said no, I didn’t know anything about it until I read about it with the minutes.
Councilman Snyder said let the record reflect that what we’re discussing
is the letter we received from Ron Miller’s office that Jacobus Borough
hosted a public safety forum on September 20 and York County
Adult Probation and Kathleen Burke with York Area Regional Police
Department presented information on gang activity as part of its forum.
And they were enlightening people as far as what to look for as far as
gang symbols and stuff. I was going to bring that up under the Mayor’s
Report. And as the mayor had indicated we didn’t know anything about
it. And I just mentioned that maybe since the police department was
there, he’s a commissioner of the police department for the borough,
he should bring it to someone’s attention that Yoe Borough was never
contacted or invited.

Meet Councilman Allar said a couple months back we mentioned about
With Police getting a police officer to come here and give us any information
on criminal trends, vandalism, drugs, things going on in the borough.
Have you set something like that up? Mayor Sanford said yeah,
originally we had, that the chief and another officer were going to
come down in November and we put that off based on the conversation
that I had with Sam. We didn’t do anything this month either but when
things slow down. Councilman Allar said I don’t’ think we need the
chief of police. Mayor Sanford said no, he doesn’t get out of the office.
Councilman Allar said usually something like that is down in the rank
and file on what’s going on. Mayor Sanford said I was thinking one of
the sergeants or corporals could come out and talk. That’s on, on eof
my to do lists.

Post Mr. Shearer asked about with the recent incident with the trespass at
night, do we need better signage to enforce? Trespass signs or a dawn
to dusk light? Mayor Sanford said no, because when they go in there,
they’re going to be doing something bad. So just call, we’ve got to
call, if you don’t call they aren’t going to come out.

No Parking Councilman Snyder said while we’re discussing that I will bring up
Only for to council’s attention. Again, if council doesn’t want to do anything about
Borough it, that’s fine. We were notified when we spoke to Sergeant Blair that
Business they will enforce parking restrictions here on the borough property, if we
post it. The last time that I brought that to council’s attention I think
there was one council person that’s not longer here, who was one of the
most person against it. I know it hasn’t been an issue, here since that
came up. If we want to do it, we need to post and they will enforce it.
All we have to do is get the proper wording as far as parking for borough business only and I think that was about it, they would enforce
it. We had that one issue when we had that meeting, there was a big
truck out there. There was a couple of other meetings that people,
we do see people parked there when its not normal business hours.
It doesn’t affect anybody at that time but they also don’t know when
there’s a sewer meeting scheduled or something like that. Councilman
Allar said one was a volunteer fireman. Councilman Snyder said well
he lived right here, Garman. Councilman Allar said wasn’t there a
group too. Councilman Snyder said they wanted to park here to meet.
Mayor Sanford said they are using the body shop lot. Councilman
Snyder said again I just wanted to bring it up to council’s attention.
If we wanted to make sure that the parking lot is open. We can post it.
Councilman Noll asked what is the downside? Councilman Snyder
said I think one of the things, what was Karen’s biggest gripe?
Councilman Allar said I thought it was that some group wanted to use
it. Councilman Snyder said a group wanted to use it and she
was complaining that there’s not that much parking in the town to
begin with and its public property and people should be able to park at
a borough building. Mayor Sanford said that actually came up at two
different times. The requests from the ladies. Councilman Snyder said
yeah, they came up twice, almost simultaneously. Mayor Sanford said
a month after each other. Council’s thinking was if we allow them to
park here, we take liability for anything that happens as they’re getting
to that house. Councilman Snyder said there also came an issue when,
I don’t think we had this block party this year. But there was a
gentleman up the street on High Street who had a block party for

come and ask permission. It was like one day before and we had
discussed it, we would rather have him parking here than on the
street. Yeah but we didn’t like the way it went down. Councilman
Allar said you probably should post it. The police, they all know
what our meeting schedule is, if they see a car that doesn’t belong
there. Mayor Sanford said if they come in and the door’s not open
and the lights aren’t on, then. Councilman Allar said and if the
closed sign is on the door that’s all they need. Councilman Snyder
said I would think they would check that its not one of us on
borough business. Like Sandy was done here today, and I happened
to come down too. The office was closed but we were here on
borough business. Councilman Crull said you could put the open
sign up. Councilman Snyder said its not like you are open. The
secretary said I don’t want anyone to know that I’m here, I am
here to get work done uninterrupted. They should know my car.
Councilman Howett asked what about certain times, why can’t we
just post it private property. The most time you have a need for
extra parking is at night time. Councilman Snyder said for
borough meetings, for zoning meetings. Councilman Howett
said for certain times. Councilman Snyder said people park here
for ball games. The secretary if I’m here on a Tuesday, I’m here
for borough business. Councilman Snyder said that’s what he
said, no parking except for borough business. Mayor Sanford
said there were some concerns that they’re was a large tractor
out here periodically, now that hasn’t been here for awhile.
Councilman Crull asked do you need a motion for it or a
hand vote is good enough. Councilman Snyder said probably
since we’re designating it as no parking except for borough
business, take a motion on it. Councilman Allar said one way
to handle that, is to get a cheap borough official sign. Councilman
Snyder said if he comes through and we can work this out with the
mayor. If you see a personal vehicle here, walk around and see if
there’s anyone in the building. If there’s no one in the building then
you know they’re not here on borough business. Councilman Allar
said you’re putting more duties on the officer. Councilman Snyder
said for the most part I don’t need them to be a cop, its when
we’re here and we’re having a meeting and there’s a truck parked
here. It shouldn’t. Mayor Sanford said most of this is going to be
generated by call ins, by complaints. Councilman Snyder said
I mean when we were trying to have that zoning hearing that
night, where he was parked was absolutely ridiculous. A motion
was made by Councilman Noll to post the borough municipal

building and office as no parking except for borough business,
borough business only and for Dana to purchase the appropriate
signage and to check with York Regional to make sure the verbage
is correct. The motion was seconded by Councilman Allar. All in
favor. Mayor Sanford said he will check on the verbage. Councilman
Snyder said I think that’s the whole key, its going to be generated
by complaint. Anything else for the mayor?

Secretary’s Report

New Effective January 1, 2009 our new email address will be YoeBorough
Email @comcast.net . The secretary said what I’m going to do is I kept
the important emails and I will reply giving them the new email
address. I will be notifying NFDC to cancel service December 31.
The cable is in and the cable is in for the televison. Mayor Sanford
asked how does this coincide with the email address on the
website, Bruce? Councilman Manns said I will have to take a look
at it and update it.

Appoint The secretary said Patty Myers needs to be appointed as a
representative to the Dallastown Yoe Water Authority beginning
the three year term on January 1, 2008. I also gave you the meeting
dates for 2009. Mr. Smith said the sewer authority meets on Thursday.
The secretary said I already contacted the authority secretary for
the dates of the sewer authority. Councilman Snyder said on
Patty’s appointment, go to love this borough newsletter. You’ll
be receiving this once you get into the system. It’ll probably take
eight months, it takes awhile. Based on the information the
secretary provided with the expiration of Patty Myer’s term.
According to an answer in the question and answers in the borough
newsletter, it states every December, the borough council makes
appointments to boards, commissions and committees based on
the expiration of the term. A former official said that’s incorrect and
you can’t do it that way. The answer: Each law has different
requirements regarding the length of terms such as hers which
has a three year term limit. Some positions do not expire until
the first Monday in January such as municipal authorities. You
just said hers expires January 1, 2008. Commonwealth Court
ruled Ross Township vs. Menhorn, that a lame duck appointment
which we are a lame duck committee, council at this point,
to a municipal authority is illegal because the term did not expire
until January. Therefore the new council has to make the appointment.

The Pennsylvania Municipal Authority’s Act has been amended to
reflect that action. So I would think based on that. The secretary
said the she can’t serve until January 7, 2008. The she can’t attend
any meetings between Jan. 1 and Jan. 7. Do you have any meetings
between the first and seventh. Councilman Howett said no. The
secretary said okay. Mr. Smith asked about the sewer authority.The
secretary said your appointments are done for March that’s when
the authority began. Councilman Snyder said we can do it at
reorganization. The secretary said I will put it on my report for next
month.

YCPC Councilman Snyder said YCPC sent information in an effort to
Emailing streamline communication with the county municipalities we’re
preferring to use email. They’re asking for email notifications,
to notify them as to what the email is so they can notify us in
timely efficient fashion.

Penn Waste Councilman Snyder said we received notification from Penn Waste
Holiday about holiday collection. That doesn’t affect Yoe Borough residents
Collection as the holidays fall on Tuesdays and Monday collection will be
collected as scheduled.

Commerce Councilman Snyder said we did receive a basket from Commerce
Bank Bank filled with snacks. They’re looking for some business.

2008 Councilman Snyder asked if Jason got the meeting dates and did

Revitaliza- Councilman Allar said I met last Thursday with Mike Waugh, on

Grant Bad news is, back in March, nine months, I was asked why no one

So the application is no longer any good. The cycle, we are in ends
at the end of this month and in his mind, he already has a lot of
commitments worked out. However if we can do this, new signatures,
new dates, several application numbers, we’re going to have to get it

going to happen next week. Councilman Allar said then we can get into
this cycle, then I think I’ve sold them on it, depending on how many
commitments he has or we’re going to miss it again. That’s where it
is. The person deal with isn’t Paula anymore, its Nadine, here’s her
number. Like I said from last Thursday. The secretary said its not
going to happen next week with the council meeting only about three
weeks away and our new grandbaby arriving soon. Councilman Allar
said we’re trying to get something together with the DCNR grant.
Mayor Sanford said before I had talked to her. Councilman Allar said
you’ve got to grab him by the lapel and sit down with as I did.
Mayor Sanford said I spoke with Nadine herself. Councilman Allar said
Mike’s the decision maker, he’s the guy you’ve got to get to. Mike told
Me, get it in here. So this cycle. The secretary said that’s not the
impression I got at all. Councilman Allar said this is the second time I’ve
gone through this. The secretary said in talking to you and from talking
them, Mr. Waugh would represent us when it went up there. There was a
chance we wouldn’t get it. That’s the last thing, the impression they left
me under. They didn’t say keep bugging them to see where the grant is.
They didn’t tell us that. Councilman Allar said you’re not hearing what
I’m saying, its staffed with political people. They don’t know if there is
Someone on the other line taping them or not. They have to say that to
be even with everyone that comes in. When it comes down to Mike,
himself, its his money, his allocation, he makes the decision, and if
someone in the back. He’s going to tell the staff to make the phone call,

cause I want to give this entity $10,000.00. The secretary said they
didn’t tell me that, that’s not what they told me. Did they tell you that?
Mayor Sanford said no. Councilman Allar said no, they won’t tell you
that. Its set up as a grant where people in Harrisburg make the decision.
The secretary said so the signed support letter didn’t mean a thing?
Councilman Allar said that’s absolutely right, it means nothing. The
secretary asked what do we do differently this time then? Councilman
Allar said since its decided by the elected official, you need to sit
down with the elected official and get a commitment out of him.
I said this when we put it in. The secretary said they did not say that.
Councilman Allar said they can not say that. The secretary said if
we apply next week, then you are going back to sit with them next
week? Councilman Allar said I sat with him last week, I already
sat with him. The secretary asked it’s a done deal if we apply next
week? Councilman Allar said I’m not saying it’s a done deal because
so late in the session. Mayor Sanford asked does he have more money
for January? Councilman Allar said he has money for this cycle.
The cycle that we put in for has already started, so as is, to make
this thing official, we have to have certain applications. This
application number is no longer any good. We have to do another
application, get another number, change some dates and signatures
on it. The body doesn’t have to change, every thing in there we can use
but we have to update it for this cycle. The secretary asked if Nadine
knows how to update? Councilman Allar said she will tell you what
needs to be done. The secretary said I don’t want to promise anything
because I may not be in next week. I won’t be able to call until
Friday. Councilman Snyder said if he has money for this cycle, the
he doesn’t have any monies earmarked yet for the next cycle The worse
thing that would happen is that it would be pushed until the next quarter.
I mean we are not even ready to move forward on the DCNR part.
Councilman Allar said that’s the point, if we want to move forward with
the DCNR that’s what makes this cycle right now at the end of
December more critical. Cause you’re going to get a decision this
cycle a lot sooner than the next cycle. Mayor Sanford asked if you have
the form in your computer. The secretary said I filed it at their office,
they did if for me. I’ll give her a call on Friday. I’m saying to get
it in for the end of December, its going to be difficult. When I went there,
they didn’t tell me to get a hold of someone,that you could have met
with them in March. Councilman Allar said that’s something else, I
don’t want to get into that. Ther secretary said that wasn’t the
impression that we want. They didn’t tell us that we were
personally to meet with them. Councilman Allar said if you want

to get with Saylor, it would be a good time. Mayor Sanford asked
if Ron Miller needed to be contacted again. Councilman Allar said if
he was, yes. Waugh, is the big player, he gets a big allocation. Yes,
it can’t hurt. Miller is going to say, give me a copy of the application.
Saylor is going to say give me a copy of the application. Mayor Sanford
Said I had to call Nadine to get the number and gave it to Ron’s
assistant down there. I thought by making a call to the office and letting
them know what it is for. Councilman Allar said I’ve tried to explain,
you’ve got to get to the decision makers, you know its not handled by
the staff, the staff had their line, they can’t show preference in any
direction. Mr. Shearer said I’ve put in for equipment and we’ve had
their staff call us up begging to fill that in and we never talked to Ron.
Councilman Allar said I think it depends who you’ve gone to. Mr.
Shearer said that’s probably true too cause Mike has a bigger area.
Councilman Allar said that’s true. Mike is getting deluged by these
things. If you want to separate yourself from the pack, you talk
to the guy. Mayor Sanford said just to clear this up, because I think
there is some misconceptions. So I’m just going to say this, when I left
a message for Ron and saw him less than thirty days later at a meeting
sitting beside him like this. I asked did you get my message about
the money that we’re trying to get for the park. He said yeah, I’ll
see what I can do. That’s not good enough? Councilman Allar said
with who? Mayor Sanford said Ron Miller. Councilman Allar said
you talked to Ron Miller. Mayor Sanford said that’s what I just said.
Councilman Allar said yeah. Mayor Sanford said that’s not good enough?
Councilman Allar said if you talked to Ron. Mayor Sanford said
and I left a message with Nadine when I got the number when we said,
I called in there and got the number because Sandy didn’t have it so that
Ron Miller’s office could have it. I said would you have a message for
Mike to make sure that he looks at this for us. Councilman Allar said
I’m here to say, Mike was not familiar with this grant, he never looked
at this grant. I had to explain it all the way through. Cause he gets so
many of these things. Personal meeting, is pulling out the grant and
sticking it in front of his nose. Mayor Sanford said I feel like you are
making accusations. Councilman Allar said no, I’m just saying
what the facts are. He had no knowledge of it. Mayor Sanford said
I am telling you at this meeting that they were both notified so you can
go with that wherever you want to. Councilman Allar said you mean,
their staff was notified. Mayor Sanford said Ron Miller sat beside me
and told me, he knew about it. Councilman Allar said I’m not talking
about Ron Miller. I don’t know anything about Ron Miller. I’m just
talking about Mike Waugh. Councilman Snyder said if it can be done,
if not. The secretary said its not on top of the priority list right now.

Buses Councilman Crull said I wasn’t here last month, but I had a complaint
from a lady on Elm Street and one from a lady on Walnut Street about
the continuous line of buses. Do you remember what time they said
that was? Mrs. Crull said when they’re heading toward the school,
morning and evening. Councilman Crull said maybe its stopped since is
a month old. Mayor Sanford said not our bus drivers. I have nothing to
do with that. Mrs. Crull said I’m just saying the bus drivers were out there.
Mayor Sanford said you already have my attention. I’ll make a call to
Larry Markel. Both the mornings and evenings? Mrs. Crull said yeah.
I’m surprised they go through Walnut with that curve.

Final Councilman Snyder said we have to do final adoption of the budget
Adoption for 2008. Nothing has changed since the preliminary. The tax
Of Budget ordinance has already been adopted which supports the budget.
Any further discussion, otherwise? A motion was made by Councilman
Howett to formally adopt the 2008 budget. The motion was seconded by
Concilman Crull. All in favor. Councilman Snyder said budget is
Adopted.

Experience Councilman Allar said Barry, Bruce and I, we met with the Work
Works Experience people, Experience Works I guess. We interviewed
Sheridan Lewis. I should have been in with your minutes, his
biography. He has experience with computers and a good running
background. I also have attached a summary of the grant support.
If anyone has any issues with that, just get in touch with me.
We do need to approve that agreement and then there’s some other
paperwork that has to go to the Department of Labor, so he can get
paid. I don’t have that but I’ll get that probably this week or next
week. At least with the agreement, Pete said he was going to look
at that to see if everything is okay on that. Councilman Snyder asked
if he has a copy of that? Councilman Allar said no. I think they
gave it to you or Pete. To get the ball rolling and not waste any more
time on this grant stuff. They can’t do anything officially until they
get that. If he has it , Tell him to fax it back to us. Let me know
I can call them and say, mail it. Councilman Snyder said I have to
check with Pete. Let’s say we’ll be calling them for another copy because
if it got into his file to check over. The secretary said I didn’t have a copy.
Councilman Allar said let me know. There agreement is going to be okay
because they have an agreement with 500 other municipalities. A motion
was made by Councilman Allar to sign that agreement with Experience
Works once we get confirmation from the solicitor and to locate the
actual agreement. The motion was seconded by Councilman Howett.

Insurance Councilman Snyder said with the change of insurance at the retention
At Dams dams. We did get a refund check of $193.00 for what the balance is.
They just need a signature in order to change the policy. I know
there was discussion made in order to actually change the policy and
do we want a motion to actually change it. Councilman Allar said
we already did that. Councilman Snyder said I couldn’t remember if
we did or not. I know we discussed it and said it was a good idea but
I don’t know if we made a formal vote. The secretary said we made it to
change the limits to $400,000 to make sure it went through. This is a
formality, it has to be signed so that insurance company can legally
take the limits down. A motion was made by Councilman Allar to sign
for the actual change of the policy to reflect those changes that were
discussed at last month’s meeting. The motion was seconded by
Councilman Howett. All in favor. Councilman Snyder said motion
carried.

New Business
There was no new business.

Payment of Bills

Councilman Snyder said we have additions to the bills: Milt’s Repair
Service for $496.90, for the annual inspection of the traffic light. Mayor Sanford said
they replaced them with standard bulbs. Councilman Howett said one was replaced
that was burned out. Councilman Snyder said he’s still not putting in LED’s. It says
135 watt traffic signal light, 69 watt traffic signal amps. South bound red light signal
light flasher, 135 watt. Mayor Sanford asked wasn’t Barry going to call him to start
doing that. It looks like he pulled all of them out and replaced them with standard
bulbs. Councilman Snyder said I know he said it was going to be expensive,
I thought they deal was as it was burned out, he was replacing them with LEDs. I haven’t seen bulbs burned out before but I haven’t seen one LED go in. Mr. Shearer said I’m
not sure about that, I don’t know if you have to relamp the whole thing because of the
changes. Councilman Snyder said the point is, at this point they were not changed to
LEDs. So $496.90 for that. Expenses for the tax collector for 2007 is $238.71. Griffith,
Strickler, Lerman, Solymos and Calkins for billing through November 30, 2007 is
$3765.70. Of course based on our discussion earlier in the meeting, portion of that
will be rebilled back to the insurance carrier. So with those additions onto the bill
list, any questions or comments? A motion was made to pay the bills with the
additional items mentioned by Councilman Howett. The motion was seconded by
Councilman Allar. All in favor. Councilman Snyder said bills are paid.

Councilman Snyder said under the visitors section, since we do have an
open council seat, the notice of the open council seat was duly advertised in the paper. Do
we have any individuals here that would like to be considered for that position? Stand up and introduce yourself. Seth Noll said I am a resident at 245 S. Main Street, Yoe. I’ve been a resident for a little over six years now and I am interested in the council seat. Councilman Snyder said very good. I know some people have had some dealings with Seth over the last couple of years. Any questions that you would want to ask Seth? Councilman Allar said I think Seth would be a great addition because of his background and his responsible position. I think he has the best interest of the borough at heart.

registered voter? Mr. Noll said yes. Councilman Snyder asked, a U. S. citizen? Mr. Noll said yes. Councilman Snyder said you already mentioned that you have been a resident for more than a year. A motion was made by Councilman Allar to appoint Seth Noll to the open council seat. The motion was seconded by Councilman Crull. All in favor. Councilman Snyder said, welcome aboard. I’ll turn you over to the mayor for the following.

Mayor Sanford asked Councilman Noll to come up front please. The oath was given with Councilman Noll raising his right hand. “ I do solemnly swear that I will support, obey, and defend the Constitution of the United States, and the constitution of the Commowealth and that I will discharge the duties of my office with fidelity.” Mayor Sanford said welcome.

Solicitor’s Report

Executive Session at 7:08PM

Attorney Solymos requested an executive session to report on litigation to council
A motion was made by Councilman Allar to recess the regular meeting at 7:08PM and move into executive session. The motion was seconded by Councilman Manns. All in favor.

Councilman Snyder said we are running a little late on the public hearing for ordinance 2007-04.

Councilman Snyder said we are reconvening the regular meeting at 7:34PM. Let the record reflect that we had discussed legal matters. The first issue, we’ll take the second one first. It was discussed about the legal opinion on the access of the dams as written in

in the legal description of our deeds and the legal opinion is that, that it is a general access for maintenance to the dams and do we have a motion then for Tom to proceed with negotiations between the Township and the property owner to move that easement down
closer to the creek. A motion was made by Councilman Howett to have Councilman Allar proceed with the negotiations. The motion was seconded by Councilman Crull. All in favor. Councilman Snyder said motion carried. The second issue that was the solicitor bringing up to council that a writ of summons was filed today against Mr. Chronister, his partner and his partnership.

Recess of Regular meeting and Public Hearing for 2007-04

Councilman Snyder said ordinance 2007-04 was advertised for 7:30PM. A motion was made by Councilman Allar to recess the regular meeting at 7:35PM to go into public hearing to discuss that ordinance. The motion was seconded by Councilman Howett. All in favor. Councilman Snyder said the meeting is in recess.

Councilman Snyder said the hearing is for discussion of ordinance 2007-04, an ordinance fixing the millage rate for the year of 2008, for general revenue purposes. Section 1: The millage rate for general revenue purposes for real estate tax for the year 2008 is here by fixed at 2. 955 mills. The millage rate for the annual fire tax for protection for the year 2008 is hereby fixed at .103 mills. Is there any discussion from the public? Is there any discussion on council? I do have one thing to add. We did get notice from the Board of Assessment Appeals from York County, that their resolution passed which they validated the assessment for Yoe Borough for the year. Our total assessment is $30,628,060.00 with $1,576,820.00 being tax exempt for a total valuation of $32,204,880.00. I just wanted to bring that up to let everyone know that based on the approximate 3 mill that we will be passing that would generate roughly $90,000.00 in income which of course last year we were $5,000.00 off for whatever reason so we should be on target for the $85,000.00 that we have budgeted with adopting this millage rate. Any discussion from council? A motion was made to ordain ordinance 2007-04 by Councilman Crull. The motion was seconded by Councilman Manns. All in favor. Councilman Snyder said, so be it ordained.

Red Lion Solicitor Solymos said with regard to the Red Lion zoning officer. I made
Zoning some suggestions, in regards to the contract that was proposed by council
Contract with Red Lion. We made those changes. Legally its fine now, prepared for
you to vote on to enter into that contract. Councilman Snyder said we will
be doing that after we come out of the ordinance hearing.

Joint Solicitor Solymos said there’s one other thing, let me see if I can do this
Comp Plan quickly. Tom is in the process of working with our sister municipality,
Red Lion and now with Dallastown with an eye towards a, to draft a
joint comprehensive plan for the three municipalities. Two ways you can
do this, that is by creating a single zoning hearing board or by getting a
joint comprehensive plan and the following that comprehensive plan by
creating your own zoning ordinances with those. There was rumor at the
last meeting, that Dallastown wasn’t interested in this whatsoever. So I
contacted Pam Shellenberger at your request. She was very helpful and
illuminated on the issues. She also thought that maybe Dallastown was
uninterested, but it turns out through Tom’s work, that Dallastown is in
fact interested, and will probably go through with it. I called their solicitor,
he had no idea that Dallastown was interested or anything else. They
hadn’t talked to him about it but now he knows about it. I think everyone
move on it. Councilman Allar said there is a memo being worked on right
now, in fact we might have had it faxed or emailed. It’s a MOU that would lock in the three municipalities to this joint comp plan. I talked to Stew in
the last few days, it should be coming in. I know Pam Shellenberger of the
county.. Solicitor Solymos said I’m really bad, MOU? Memo of under-
standing? Councilman Allar said right. I talked to Pam today, she has a
copy, I know its been circulated. I’ll get a copy, give it to Sandy then she
can copy it to you. But we do need to get closure on this. I’ve got meetings
in January with the other municipalities. And they’re going to want to know, that we’re in sink with this agreement. So Pete will need to take a
look at this as well. Councilman Snyder said that’s what I was going to
say, I think everyone on council knew that we were investigating this at
the last meeting. I think now because there were more discussions that
Tom held with Red Lion and Dallastown and with the solicitor. I think
We do need a formal motion at this point so Tom feels comfortable with
expending these funds that council’s on board with pursuing this and
then if any MOW does come through after review by our solicitor, for
his approval, the borough can go ahead and sign this and the borough
proceed in trying to get on board with the three way. Councilman Allar
said one of the many values of the comp plan. Its getting more and more,
when you go for state money, the question is raised in either an application
or in other ways, is this part of your comp plan? And its even to the point

that actually some denials occur because there wasn’t a comp plan. It
forces municipalities to update their plan. Ours goes back to 1962 so,
it could affect us if we don’t do this, in a monetary way, at some point
with the money. Solicitor Solymos added that the state likes this also,
for the operation, that you are working together and that saves money
for everyone technically. That’s really an important part of the plan.
A motion was made by Councilman Howett for the borough to
Proceed with investigating this joint municipal comprehensive plan and
of course after review with the solicitior to sign any MOU that would come through to further along this joint endeavor between the three
municipalities. The motion was seconded by Councilman Noll. All in

Councilman Snyder said I will bring to order the public hearing as advertised for 7:45PM to discuss ordinance 2007-05. This is an ordinance for the Borough of Yoe, York County,
Authorizing the Borough of Yoe to enter into an inter-governmental cooperation agreement with Red Lion Borough to provide zoning officer services to Yoe Borough
providing a severability clause and providing an effective date, Ordinance 2007-05.
Everyone had an opportunity to look over this in their packet. As we discussed; myself,
Peter and I’m not sure but Tom may have had some discussions with Pete and Red Lion.
We got this pretty much the way we want it as well as the agreement which was discussed in the regular meeting. Is there any public comment on ordinance 2007-05?
I will make one public comment on behalf of our current zoning officer. I know it
probably came as a shock to you, but this was done mainly, we see this as an option that the borough can save money in trying to join services with another municipality. Not really to try to take this as a reflection on yourself but more on the financial end. We think that Yoe Borough would be better served with zoning services with Red Lion Borough. We want to thank you for the couple years that you’ve been here serving Yoe
Borough and when you were here one month, you were in litigation. We will be working with you on that in the future. I’m not sure how that will affect that litigation. We can discuss that later. We want thank you for the time spent with us. Any discussion from council on ordinance 2007-05? From the mayor? A motion was made to ordain ordinance 2007-05 by Councilman Noll. Agreement with Red Lion for Zoning Services
Councilman Snyder said first order of business since we’re still in Solicitor’s Report and since we just passed ordinanace 2007-05, discussion on the actual agreement between Red Lion and Yoe borough for the services of the zoning officer. Pete, do you have anything further? Solicitor Solymos said no, recommend it as amended and with the suggestions put in it. Mike was easy to work with and understood what we were
Suggesting. I think it is a good agreement. Councilman Snyder said I did have an opportunity to get in touch with the borough manager. We made a couple of revisions
to this that I’ve seen. Then of course I met with Pete, we had gone over some of the issues that he had, had. Its basically everything that we’ve discussed Tom, at the meeting that you and I were at. It looked good to me. Did anyone else? No one got a copy because there were so many revisions, it wasn’t sent out with the packet. Everyone will received a copy of this in their next month’s packet so. Plus Red Lion will. This is the most current one? The secretary said this is the one that you put into the folder. Councilman Snyder said yeah, that is the latest one. I see they took out very six months. So that’s the latest one. Solicitor Solymos said there should be something in there that everything should be put into writing. Councilman Snyder said yeah, and that they’re actually allowing e-mail to be in writing. Solicitor Solymos said yes, e-mail is fine. Councilman Snyder said
these are some of the other ones that I see in blue and stuff. It says borough council, in
the event the agreement is extended beyond its initial term, it shall be then considered
automatically under the terms and conditions therein until terminated by either party. So
this is the latest, I just wanted to make sure we are signing the latest one. Any other discussion, if not? A motion was made by Councilman Crull to sign the contract with Red Lion Borough for zoning services. The motion was seconded by Councilman Allar. All in favor. Councilman Snyder said motion carried. I guess, Barry has been in touch with you then on a smooth transition between. Mr. Baade said he said he’d give me a call but I haven’t heard. Councilman Snyder said okay. You don’t actually have to wait on him, if
there’s going to be a time that’s more convenient for you and you don’t want to wait on Barry, just feel free to give Dan Shaw a call at Red Lion. Mr. Baade said I don’t know him. Councilman Snyder said just give him a call and introduce yourself, say hey, I’m
Richard, I’m the zoning officer. Mr. Baade said Barry said he wants to set it up and he wanted to sit in on it. Councilman Snyder said Barry’s not here, so I don’t know where we’re at and just go ahead and feel free to make that call and give Barry the heads up, say I put the initiative in, I set it up and this is when its convenient for us. Councilman Allar said if at all possible I think Barry should be there. Councilman Snyder said yeah, Barry

should be there. Councilman Allar said Dan may have questions that Dick can’t answer, policy questions. Councilman Snyder said I’m only concerned if Richard is saying that
Barry hasn’t contacted him yet, and we’re already at the eleventh. I don’t want, all I’m going to say is that we have to proceed with this and we have to make it happen by January 1st. I can’t sit here and point a finger at him, I don’t know where he’s at. Councilman Allar asked if we could give Barry a call? Mayor Sanford said he’s in a meeting. Councilman Allar said I don’t’ mean right now, tomorrow. It could be set up for this week yet. Councilman Snyder said yeah, they can. Councilman Allar said its just
that Dan may have policy issues. Councilman Snyder said yeah. Councilman Allar said and its not going to go anywhere, Dan’s not going to know about it. Councilman Snyder said I just don’t need this, you know what I mean. Councilman Allar said yeah, I know. Councilman Snyder said I’m sure you’re going to cooperate with us then, at this point maybe Dan’s heard something. Councilman Allar said he hasn’t, he has been wondering about the meeting. I told him its going to be set up.

Garbage Solicitor Solymos said I don’t’ have anything else that I’m aware of.
Contract We’ve covered an awful lot, and we’re doing a lot of stuff here. Sam and I
are going to meet with regard to the garbage contract. We’re looking for a
bill to see if they’re mixing before we get together. We suspect that they
are and that would be a violation of the contract. We tentatively scheduled
it for Thursday and since we don’t have the formal documents in, we’ll do
it as soon as they come in. So Sam and I will meet on that. So that’s all I
basically have on that. The secretary said we received our new bill for
November and the $480.00 is added in so that isn’t listed on the bill list to
be paid so that balance is still carrying on the account.

Box/Swale Councilman Snyder said an issue that was brought up after you left last
Elm St. month, it actually came up under maintenance. Did you want to ask the
question or tell Pete what you want to ask about that culvert up there on
Elm Street that I said that we’re not going to do anything until they come
to council and that’s going to be something the solicitor has to comment
on. Mr. Shearer said we have up on Elm Street, a drain box in the street
pipes into a preformed concrete box that has an open end that goes into
a swale. When we had some problems up there this summer with the gas
company work, the home owner there requested that I look into having a
cover made for this concrete box. And in talking with Ron and Sam, I
guess the borough’s opinion has always been that, that’s private property.
Solicitor Solymos asked is this the same one I look at one time up there?
Councilman Snyder said that was the one close to my house, this is the
same thing where a box dumps into a swale, and the swale runs through
private property. Solicitor Solymos asked if the box was built by a private
individual? Councilman Snyder said well I think the box was built by us
but the water comes out of it and runs across private property. Solicitor

Solymos asked an actual drainage course or did we move it there?
Councilman Snyder said probably the same thing as we have back on our
street and the thing is that they’re now saying they’re going to have a baby
in a couple months and they want us to do something at this swale. And I
said based on prior history with. Solicitor Solymos asked what do they
want us to do, put a pipe in right? Mr. Shearer said all he requested was a
cover for the box so they child couldn’t fall into it. Solicitor Solymos
asked a cover for the box in the street? Mr. Shearer said no, no, for the one
in the yard. A concrete box that is covered over with dirt and grass and
there’s about an eighteen by eighteen opening that you can actually crawl
up into a 20 foot or so to the back side of the drain box. Councilman Allar
said there was another situation a couple of years ago where stakes were
put down or hammered down, I think to keep a child or young kid from
getting to the box on Elm. Mr. Shearer said that’s on the other side.
Councilman Snyder said that’s on the upper side. Mr. Shearer said that’s
where this water is coming from. Councilman Snyder said but that was
put in right there on the right of way. This actually, well image Wendy
Tyson’s closed in box culvert. The only difference, that had naturally
running through it. This is strictly for stormwater but is running their
yard. And this is closed in. Solicitor Solymos said someone put it in
years ago. But you don’t want to go and read the minutes over the past
ninety years. Councilman Snyder said we probably should say the same
thing like we did up at Park. Mr. Shearer said from my understanding, if
I’m not mistaken here, Ron, you said the borough didn’t do that.
Councilman Crull said I own the property right up there along side of it
and the yard is probably 150 feet long. And this culvert was put in, they
put it in to make it easier to mow grass. And they only went about half
down the yard. Then they stopped from that point it dumps out into a
swale and runs back out into our alley. I know it was done just to make it
easier to mow grass. The borough didn’t do that one whereas the one
you’re talking about, we did do. Councilman Snyder asked the one?
Councilman Crull said the one up behind your place. Councilman Snyder
said I know the borough put that in. Councilman Crull said there’s been
at least seven to eight different owners up there on the house over the
last twenty five years. Solicitor Solymos said I think its private but just out
of curiosity what’s going to set him back to put a screen in it? No big deal
is it? Mr. Reichard said, we have details on that, its just a bar bracket you
put in with hinges and a lock, a couple hundred to build. Councilman
Snyder said I think at this point what I was recommending at council last
month, council not take any further action at this time. They’ve
approached Dana but they haven’t officially approached borough council.

You needed to be apprised of it because this is déjà vu all over again.
And its on the radar. I’m just telling you, its on the radar. But I think
at this point no action and if they come forward again, then take there.
Yeah, we’re going to have to have our engineer look to see about it.
Even then I mean so the engineer says yeah we diverted the water. We
diverted the water back there on Park Alley, we still took the position
that its running across private property so we’re going to let it go. If
that’s the case, then let’s, this is your call. Solicitor Solymos said I’ll make
it when it gets to that. Councilman Snyder said I just wanted to get you up
to speed, it came up after you left. Solicitor Solymos said this is not a
situation where you as a community could say look we can’t do it however
our engineer would be glad to come over and tell you what needs to be
done and give you an idea what it might cost you. You may want to
consider doing something like that. I don’t’ know if you even need an
engineer or not, you can tell them what needs to be done. I don’t see
opening that pandaro’s box. Councilman Snydre said I just wanted to
give you the heads u, because it came up after you left.

Amendments Solicitor Solymos said the only other thing I have was that I got a
To Zoning heads up about five minutes before our meeting that Jason has proposed
Ordinance certain amendments to the zoning ordinance with regards to buffering
and screening and there here for your review and comment. I have no
comments but with Jason’s expertise here, I’m sure we need it. I have
to just put in the appropriate form for adoption in an ordinance once you
folks had a chance to look it over and decide what you want to do with it.
Councilman Snyder said Jason didn’t have an opportunity to copy, to
make numerous copies to everybody. I think there is three floating around.
Four cause the solicitor took one. Now you did say that at a pre meeting
discussion here, you did say we could advertise this for adoption and
could start enforcing this even before its actually adopted and even goes
to the planning commission, YCPC. Do you recommend , do you want a
motion to actually advertise this awhile? Solicitor Solymos said first of
all I don’t want to advertise it until you guys, the board, council have
a chance to review, answer any questions they have and if not, then I’m
told to prepare the ordinance. Then I’ll prepare it and advertise it, we’ll
advertise it for adoption, we’ll ship it out to York County Planning. The
interesting thing is doing this right, York County Planning meets the first
week, we could do it in such a way that we might have all reports. No,
wait a minute, no, we meet the second. Its going to be hard to coordinate
it with York County Planning, to get the comments back in time. But
you’ve got a pretty good relationship, I do too, we can call them. The staff
could tell you what they’re recommending for information. I think
the planning commission meets on Thursday. Councilman Snyder asked

if we have to formally advertise and adopt before we send it on to them
or can we take this form as is, and make a motion to send it on to planning
to get their comments back before we even look at them. Solicitor
Solymos said I think they will give you informal insight and I think their
formal action via the MPC if you haven an ordinance that you want to
adopt it, has to be reviewed and you must receive comments from the
planning commission. Doesn’t mean you have to accept it. Councilman
Allar said if at all possible to keep with what we want is to get the
comment of the planning commission. Councilman Snyder said all I was
saying was can we move this along, make a motion , say send this right
to York County Planning and have their comments come back in January
and if in February we make a motion to accept their comments, make any
revisions, we’d have time to look at it and move on from there. Solicitor
Solymos said let me ask you something silly, it’s the middle of the winter,
are we anticipation any plans coming in that would require screening. Are
we doing this because we’re anticipation something coming in very
shortly? Mr. Reichard said I haven’t seen anything at the moment, but
we have no way of knowing that. Solicitor Solymos said well, so we
don’t, this is not done to protect something because there’s something
serious in the wind? Councilman Snyder said no, we just want to clean up
the borough ordinance. Solicitor Solymos said then I think we should just
start doing it and just do it in the normal course. Councilman Snyder said
okay, then at that point then. Solicitor Solymos said I can get it ready for
adoption. The secretary said, no, I don’t have a copy. Councilman
Snyder said if you want to make a copy then, make copies for everyone
on council and put it in their next packet and then they can have
comments, look over it for the next meeting and have comments ready
that we’ll discuss at the next meeting. Mr. Reichard said that’s not in
a formal ordinance. Councilman Snyder said no, at that point if
everyone is in agreement with it, then what we can do is make the motion
at the next meeting to have Pete run that into the formal ordinance form
and we’ll start the ball rolling that way. And if takes two months to get it
through planning, it takes two months. Councilman Noll asked if this is
at all in response to what was fought within the last two years in the
municipality? Are there things specifically to look at within zoning?
Councilman Snyder said there’s always things to look at in zoning.
Councilman Noll said there was land use issues on the number of
houses, lots and things like that. Councilman Snyder said it addresses.
Councilman Noll said those issues don’t come back to haunt everybody
since the period has expired. Mr. Reichard said the ordinance will soften
the impact of development of that nature. Councilman Noll said so it
possibly can back and the borough can say that everything in the
zoning must now be an acre or ½ acre per structure. Mr. Reichard said

they still have the right for that type of housing and the problem was
they originally had a two acre minimum tract in order to allow that
type of housing. Council considered increasing the size of that tract
to five acres. That would cause exclusionary zoning within the borough.
That would have prohibited that type of housing. So we want, we did
leave it at 2 acres and established these buffer zones basically 25 feet
wide that includes trees, shrubs, hedges within that, to protect lands of
recreation, health facilities, things of that nature, from high density
development or industrial uses. To proved an extra area that things are
offset from property along there. Councilman Snyder said so instead of
getting 4 buildings like he negated to, he may get 2. Mr. Reichard said
may get 2, may get 4, however there is a barrier. Really that’s an
option we had. Councilman Noll said what you’re saying is you can’t go
through all those for any land use in the borough that is in that type of
zone, you can only build that type of house. You can’t have any type
of high density housing. Councilman Snyder said that’s what we tried
to do and that’s why he said we can’t do. We can’t exclude out high
density housing. Which was what my original intent was, to say okay
for high density we need a minimum 2 acre lot, make it a five acre
lot unless somebody goes and busy a lot of houses together, you’ve not going to get 5 acres in Yoe Borough. And that’s when he said
then that’s when we are running into the problem of exclusionary, that
you’re not allowing for. So this way we’re still allowing for it, its
just that there’s extra protection there and by doing that, instead of him.
Like in that plan, that he presented he was able to get four structures in
There, because of these extra buffers, he may only be able to get three or
two depending on how it works out because you still have it. Mr.
Reichard said and the particular plan had infrastructure in it, of that
Nature, and because of the buffer area. Councilman Snyder said he
can’t run stuff in there now. So its going to make it more difficult to
get the amount. If he’d had put two buildings up there to begin with,
I don’t think we’d had near the contingency there. That was the intent
of this, that’s how its written again, come back with comments at
next month’s meeting and we’ll go from there. Solicitor Solymos aid
then I’ll put it into a format that you can adopt as an ordinance and
advertise for February. Councilman Snyder asked anything else for the
solicitor?

? from The secretary said the auditors called me and said they have a new
Auditors format in doing the audit. They’re coming to see me December 19 and
mentioned they’ll have questions on litigation. May I forward them to
you if they have any questions to be answered? Solicitor Solymos said

Billing Councilman Snyder said I will make another comment while the solicitor
Forwarding is here. We did receive his bill for the end of the year, all but December,
until November 30th. You will see it when you see, you won’t see it on
the bill list because we just got it tonight. There are issues in there with
the Cottrell hearing. We are suppose to be billing that back to our
insurance carrier. They said that they would take care of it. So unless the
solicitor tells us otherwise, we will be adding that to our bill list to pay
the full amount with the submission of those amounts, highlighted,
and sent to the carrier for reimbursement. So if you notice that on next
month’s bill list that’s how we’re planning on doing it. Councilman
Allar asked if you are billing the full fee? Solicitor Solymos said I don’t see any reason why we shouldn’t but unfortunately I am doing it for
you guys, they’ll pay that at that rate. Councilman Snyder said
unfortunately, he was working on our behalf not on theirs and I know
what you mean. Solicitor Solymos said that was a very bizarre. They had
asked me if I wanted to take it over on behalf of the municipality. I said
no, because I was a witness, anyway. Councilman Snyder said the same
way I brought that up, the same way with the zoning officer’s report,
his time on his bill that he spent with the trail and everything with the
hearing. I should say that’s on there, will be billed back. We’ll just hang
that up front, and getting reimbursed. So I just wanted everybody to know
if you see that on the bill list. The secretary asked for the definite address
to send the billing to. Solicitor Solymos said we have that and if you have
any problems getting that bill reimbursed from the carrier to let him know.
The secretary will send that out ASAP asking for payment. Councilman
Snyder said I don’t think they know they are getting the bill.

Holiday Councilman Snyder said on behalf of the council, thank you for another
Greetings year for your services. Hope you have a happy holiday and a safe one and
And Thanks we will look forward to another year. Solicitor Solymos said you may say
Merry Christmas, I will not be offended. The secretary reminded Solicitor
Solymos that the next meeting is the first Monday of January for
reorganization. Solicitor Solymos said someone who represents the firm
will be here. I don’t remember whether I came to your reorg two years ago
or if I went to Hallam Borough’s. I don’t remember. The secretary gave
the solicitor the list of the 2008 meeting dates. Councilman Snyder said
we will let you know if there are any changes to those dates.

Main St. Mr. Shearer said we did receive plans for Main Street resurfacing slated
for 2008. With the overlay there, there will be a higher grade of mix,
76/22, which I think is like a polymer based asphalt. This is to get a
better skid resistance on the hill, better aggregate and polymer. So that’s
they’re answer to what they intend to do out here. They will be doing that
through the majority of the borough. That’s what they’re going to do.
Councilman Allar asked if its going through the entire borough area.
Councilman Snyder said from what I understand of the project its going
to start up here at Sheetz and go entirely though to the Tom’s in
Dallastown. Mr. Shearer said a portion of it, outside of town and stuff,
They will be using a standard super pave mix. John had requested, sent a
letter. He requested that I follow up about the milling because we
requested them to do something about the hill before they do this
project. I did call Terry Sprenkle again today, he was suppose to get back
to me. They still say yes, they are intending to mill. But I guess the
weather has kind of held them up. The reason they are looking at June for
the project, is because Dallastown has their work that needs to be done in
the spring also. Mayor Sanford said if he doesn’t come through with that
promise you’ll see another article in the paper. The new manager vowed
to make corrections in the county.

Roof Mr. Shearer said I did get a price from Nick Sabold, of Sabold
At Park Construction for the roof over the kitchen area at the park. The
estimate was $3924.00. That included to remove the roof over
the section of the kitchen back to the little valley there where the
main roof comes in. So take the chimney down at the end because
that is part of the problem. Because the flashing around there is
getting water around the chimney. The chimney no longer serves
a purpose there. And that the roof, its currently a thin roof, put the
pitch in it is so level that I guess that’s one of the biggest problems.
The eves and stuff filling up when there’s snow accumulation. The
water is laying there basically in those areas and causing the rot. What
he is proposing to do is to take the old roof off and remove the chimney,
replace rafters wherever needed to be replaced, and rebuild the deck
with plywood and a rubber roof on top of it. I didn’t know for sure
what we would be looking at there, it does fall under the $4,000.00. We
wouldn’t need to get any other bids. I don’t’ know if you want me to
get any other prices or if you want to push forward. If you are getting this
done anytime soon or if you’re going to corporate this into future work.
I do think we are getting some water in around that area. Councilman
Crull said everything you said sounded good until I heard plywood and
rubber, rubber over plywood. When I used that rubber roofing, they had

another material that I was to put over the plywood, now I don’t know
if they’ve changed that. That should be in your category. To put a rubber
roof over plywood when I did that over my own garage up on Elm St.
they told me not to put the rubber right over the plywood. They had like
a sheeting that had fiberboard that I had to put over the plywood at first
to make the rubber last a lot longer. Maybe you want to inquire into that
and make sure we’re going to get something that might last longer than
four to five years. That rubber roof I put in is about 15 years old already.
I did it the way that they told me to do it. Councilman Snyder said I just
heard an agreement with our borough engineer. I know we just discussed
last month about getting on board with this park project in February and
see if we can bring something together and get a plan together so we
can start working on that. Personally I would hat to put $4000.00 into
this, which can be part of that grant. Councilman Allar said I think that,
that is many many years away. Councilman Snyder said yeah but if we
get the plan together and get the thing approved then we know that
any money like this that we spend would at least go to matching funds.
I don’t have the problem of spending $4000.00 but a least then its
going towards matching funds. We can say, look I don’t care if this is
a year and half off but we’ll put $4000.00 on the park now but at least it
goes towards our matching funds. If we do it now. Councilman Allar said
but again you have the chicken or the egg, its hard to put a plan together
if we don’t know how much money we’re going to have. I know with
CDBG for example, that’s not going to be decided by February. I don’t
expect to hear from them as a matter of fact I was going to talk to
Jason about that. Somehow we got our priorities screwed up. So you
know, I would say its very doubtful that we’re going to have a plan
in February or March and then it takes I don’t know how long its going
to take for Harrisburg to make a decision on that. If this is from Dana’s
opinion that more damage is going to occur then maybe we’ll just have
to bite the bullet on it. Mayor Sanford asked if that can be patched
anyway, temporarily to get us over the winter. Just to keep water from
running in. Mr. Shearer said I could cement the heck out of it. I mean
the roofs are connected, cement everything up and see what happens.
I don’t really think we’re going to do much more damage. Except
maybe lose ceiling tiles from water coming in, I think the damage is
already done. Councilman Snyder said to the rafters and stuff. Mr.
Shearer said yeah, the damage is done. Councilman Noll said more
and likely the cement won’t do it. Mayor Sanford said maybe there
is some newer stuff out there. Councilman Allar asked if there are
any contractors out there particularly over the winter that would
contribute some labor for materials. There are contractors that help
out municipalities. We could make a contact and see what happens.

Mayor Sanford said I personally don’t know of any. Councilman
Allar said maybe any that work for the school district. Mayor
Sanford said nobody works for us for nothing. Councilman
Snyder said number one, its not budgeted for, for next year, we
would have to take it out of capital reserve if we did it. Number two,
I know what you just said about the DCNR grant, the problem and
I don’t want to start a big debate here. I want to keep things moving.
But I will say, the clock is ticking on the DCNR grant. We’re
already 2 to 3 years into it. Councilman Allar said we have until the
end of 09. Councilman Snyder said at the end of 09, we know we have
$70,000.00. We don’t know when that other money is going to come
In. If we start working and plan in February/March and we proceed with
only the $70,000.00 and we try to com up with how we’re going to
come up with matching funds to get as much done as what we can. And if
the only thing we can do is tear that building down and build a new one.
Tear down that and the bathrooms, build one new building. How much is
a new building going to cost, $40,000.00, $50,000.00? That can be the
plan and make it ADA accessible. Its not like a whole lot has to be
in there. The point is we know we have $70,000.00. We keep putting this
off and the building is getting worse and worse. At the same point, I hate
to spend the $4000.00 when that could go towards our matching funds.
Food for thought. But as far as right now, I guess it’s the consensus of
Council that it’s a dead issue at this point. Because we at least know
based on the consensus with the engineer that its not viable to put
the rubber roof like Ron said right over that so. Mr. Baade said there’s
another issue, that’s in the middle of trees, correct? Trees and rubber
roofs don’t get along very well. Branches fall off and then you can have
a hole right through the rubber roof. Mr. Shearer said that’s true too.
Councilman Snyder said so rubber may not be the way to go. Once you’re
thinking of putting that on, you might as well put on a 20, 25 year shingle.
Mr. Baade said then there’s no ice dammed up underneath the shingle.
Mr. Shearer said, to me I think the fix would be if we get a good foot print
of the building at that end, we should look at repitching that area so that
it has a steeper slope. Councilman Snyder said oh yeah, and we may find
once we get into this plan that’s why we need to get the engineer involved,
we know we have $70,000.00 to work with, we just have to figure out
where the matching funds are coming from. But we know we have that
$70,000.00 to work with. It may be cheaper to tear that down and the
existing bathroom, rebuild it new and combine everything into one
building for $70,000.00. Mr. Baade said you’d have to get it up to a
3 12 pitch. Councilman Noll said we have an education center that’s done
projects like this and if you’d like I can take a look at it and possible get

the work done for nothing. Councilman Allar said, I said about
Vo-Tech, Vo-Tech does these projects also. Councilman Snyder
said that’s what I’m saying we know we have $70,000.00, our
issue is where are we coming up with the matching money. We
may not find out, I know you had a meeting with Mike Waugh,
but they’re not going to be able to give us definites and even
when the money comes in until the end of the fiscal year, which
is June. I mean we keep putting this off and I’m thinking we’d
better start making a decision to go with what we know we have,
if more money comes in that’s great. But just like Seth just said,
there’s this opportunity for in kind contributions. You’ve already
talked to Jeff with his contribution on some engineering. Barry
knows about Vo-Tech. Okay I’m hearing about all these in kind
contributions and we’re sitting on this $70,000.00. Its like I don’t want to be putting $4000.00 into a roof if the engineer comes back
and say in the play is, tear down the two buildings its cheaper to
build new one that’s ADA accessible than it is to revamp one. That’s
all I’m saying and that’s why I think we need to start keeping on the
ball, keep on the radar. Because yeah the building is getting worse.
Councilman Noll said at this point, I do estimates, at least have that
Amount. Throw some money at the project to see what we’re looking
at. Councilman Snyder asked is it worth doing now or do we need
to do. Mr. Reichard said like Tom said, the plan is going to take
awhile to develop but if you are concerned about the building falling
down. At this point it makes sense to put $4000.00 in the building that
includes if we do the renovations at the park in the grand scheme of
things. Councilman Allar said what I’m saying, Vo-Tech and some other
entities is willing to fix the roof, it’s a done deal. It may be temporary,
at least its done for the immediate. Then we don’t have to rush this plan.
I think having a handle on the money makes more sense that getting
The plan. The money is going to dictate what the plan is going to be.
I don’t what to anger the people at DCNR by making 52 different
changes as more money comes in via the grants, that we may get,
maybe we’re not going to get them. And then go back and forth and
readjust the plan. Mr. Reichard said we can build a plan with just that
money, we know we have $70,000.00. We can shoot for the other
$70,000.00 to match it so we’d have $140,000.00 for the plan.
Councilman Noll said if you want a design on the building , I can do
it for nothing and give you an idea of what its going to cost. Councilman
Snyder said well work that up, I mean if you can work that up and say
what it would cost to put in bathrooms and a building that has capability
in there,and what it would cost to tear down. Councilman Noll said

for the $70,000.00. Councilman Snyder said I have no idea what it will
cost, I have no idea. You see, who knows. Then we have more of an
idea which way we would want to go. That’s not saying we can’t
renovate what’s up there. Councilman Noll said I can stop u there
and take a look. Councilman Snyder said at least for tonight’s issue that
no action will be taken on the $3900.00 for the roof until we have more
information.

Trees Mr. Shearer said also on the park, I had a meeting with Matthew Kern,
At a forester with DCNR. I was trying to get some information on what they
Park call urban forests. We know we don’t have a very large tract, we do
fall into urban forest area. The state has some initiatives to try to maintain
patches with trees. So he is trying to see if he can get, what help he may
be able to get as far as additional trees, cheaply to plant. There are some
from the Bureau of Forestry. Also the Conservation District is having a
planning sale coming up in the spring also where we might be able to get
material from, it would probably be a couple hundred dollars to get some
trees. One of the areas that I would really like to plant is the area over
looking the tennis/basketball courts, that hillside that adjoins Rexroth’s
property. Basically my concern there, that we’re tearing the ground up,
there’s some patches there with pretty dead soil. I’d like to see to maybe
put some plantings on there to save a lot of the bank. Add some smaller
trees around the building area not directly at the building because we
don’t know what we’re going to do yet. Just try to maintain the health
and maybe add some new growth. He hasn’t gotten back to us yet, we’ll
see what he gets.


Small Mr. Shearer said just on a limb here, the last thing you see below is
Wind small wind turbines. I don’t know if it will even benefit us but I had a
Turbines brainstorm onetime, that the wind blows pretty good here and up at
the park. I did run across at the PSAB website, where the Borough of
Minersville got some money from DCNR for small wind turbines from
a private organization, basically they installed them. They use it to
offset their electrical consumption at their pool area. There more hilly
than we are, Schuykill County. But if its something we can get free
money for, do we want to see if we can do something to see. There
small, basically a couple mega-watt wind turbines and see if we can
offset some of our utility costs at the park and here. And if we could
sell it back to the utility company and that would offset our utility
bill. Try to make us a little bit more greener. Councilman Snyder asked

if you want a motion to proceed with that? Mr. Shearer said yeah,if you’d
like, basically I’d like to keep it real informal, no expense. I don’t know if
its something that is going to be billable. I’d let you know. Councilman
Snyder said I don’t think you need a formal motion, I think you have the
consensus of council to proceed with that. And on behalf of council I want
to thank you for your innovation idea. Good luck on it. I give you kudos
for that. I never ever even saw that thing. Sounds like a good idea and if
it works, great. Mr. Baade said to take a look at Northern Hydraulics
catalog. Mr. Shearer said that’s where I actually saw them for sale
originally. I kind of got the idea from that. I thought it might be something
we could get grant money for. I just happened to stumble upon the
article about Minersville. Councilman Snyder said well again, we
appreciate your innovative thinking there, that’s what we need to do.
Councilman Allar said there are firms out there that might do it for
free to get their prototype out there and get advertising.

Selective Councilman Snyder said I just had one question while you were looking
Wildlife at tree conservation up at the park and you had that meeting with the
Control forest. Has anything been mentioned about selective wildlife control?
You and I had discussed it as far as what may be there to help to maintain
our trees. Mr. Shearer said actually I did approach that subject with him.
Councilman Snyder said anything to save the trees.

Notify The secretary said I wanted to let you know that when Gail Koller is
Gail sent the contracts to send out for 2008 that she will be notified that
Koller if we do improvements at the park in 2009 that there could be
cancellations for the reservations she takes in 2008. I just wanted
you to know that she will be informed that the council is starting to
think about improvement/changes up there. Councilman Snyder said
we almost need to because at this point we don’t know how this is going
to go. The secretary said you and I had discussed this and there are
people who automatically book their date this year for next year and they
need to know that possibly this could affect their rental. Rentals occur
between May and October. So it may hit the time when we are renovating,
we just don’t know.

Four Councilman Allar said last month I mentioned about the four wheel drive
Wheel mower that North York was selling. In the meantime, Red Lion has bought
Drive it. Stew Graybill said he is willing to let us use it at not cost for like two
Mower days a week which is more that enough to cut the basin and use it in the
borough as well. So the first step and Dana and I talked about it, have

Dana, Barry and maybe George take a look at it and make sure it can be
Done And at that point, I told Stew that I’m not willing to burn bridges
with the township and tell them that we don’t need them unless we get
something in writing. I want a written commitment for those two days
a week. He said again, no problem. Dana and Brett can get together.
Again just a recap, there are three advantages here, one, if we cut
the grass, we avoid a $3500.00 to $4000.00 bill from the township even
though its divided among the two other municipalities, its still our biggest
cost that we have in maintenance; two, we can now bill Dana hours, his
hours now go in and we get the money back; three, we have a mower we
can use, and Dana can talk more about this, we don’t have to buy mowing
equipment now. To be fair, I would want an agreement that we would
share 50% of the maintenance costs, things like that. So that’s where we
are at, I’ll wait until I hear you’ve looked at it. Councilman Snyder said
the only thing I’d add to that before we actually get into maintaining or
mowing at the dam, is to check as you said we don’t want to burn bridges
with the township, is to check with them and make sure what agreement
that they may have with the people that are currently doing the mowing. And if they have like a two year, three year contract and how that may
affect that. I don’t know what they have. Councilman Allar said I gave
Scott Depoe, a bit of a heads up and that did not come up. Councilman
Snyder asked that they did have a contract? Councilman Snyder said
nothing, I didn’t ask him point blank on that questions as to that.
Councilman Snyder said we just want to make sure that isn’t going to
affect anything there.

Engineer’s Report

Update Mr. Reichard said I actually don’t have a whole lot to go over. Most of
On Dam it is going to be an update for the dams. I talked to York County
Project Planning Commission and they told me they received the commitment
letter from Red Lion Borough, that was still outstanding and they indeed
received it, in the amount of $10,000.00 which is good news. They also
contacted me to try to find out the status of the state funding. We have
not received an approval letter or a denial letter. So I contacted DEP
directly, got right to the department manager for the grant program
and basically hit a wall. She wasn’t willing to give me very much
information. I did find out some reason why. They said our application
was received and they said it was reviewed and it was scored. All the
applications were forwarded to their executive office for final approval.
And that is had been there for some time.

Zoning Mr. Reichard said I made a couple of copes of the zoning ordinance
Ord. amendment. I apologize for not making more. I will make more copies.
Amend. The secretary said I’ll make the copies, I was instructed to make them
to include them with the packet for the January 7 meeting.

Final Mr. Reichard said we came out today and met with Dana and went
Dam through the dams and took pictures to submit with the inspection
Inspect. report for DEP.

Final Councilman Snyder said for the engineer, we did receive a notice
Inspection from York County Conservation District that the final inspections
John were done for the John Adams subdivision. Guess everything
Adams looked good there. Councilman Crull said I want to comment on
Sub. that, the pond that’s over there. Jeffrey Firestone’s name is on the
paper. Find out when they’re going to close that thing up over there since
I called before. He had promised me that by June it would be totally
closed up and seeded and so forth. I’d like that in the record. The
secretary asked if it was Jeffrey Firestone that you spoke with.
Councilman Crull said let me check my paper. Councilman Snyder
said that was the responsible party. Mr. Reichard said that was a final
inspection that wasn’t to close out a pond. Councilman Crull said I
thought it was Firestone. The secretary said Jeffery Firestone is who
the document is addressed to. Councilman Snyder said let the record
reflect that Jason has just pointed that, that’s just a final inspection
not the close out on the permit. So there’s still recourse there before
they close out the permit. So that should help you there, Ron. He said
to make note that its just the final inspection, not the close out of the
permit so we still have recourse before they close out the permit.
The secretary asked if we will receive notification like that, Jason, for
the close out of the permit. Mr. Reichard said this is the final inspection
what they’re doing, they’re requesting a notice of termination to be
completed. Another for is filled out and submitted for approval to
terminate the NPDES permit so. That process is on the way. They’re
telling you by June, I’m getting the impression that they’re trying to
get out of this now. Councilman Snyder said do you want to make
contact with them now, to say this is still an issue before they close
this out. The engineer then is going to make contact to the County
Conservation District to make sure they’re aware that the issue
that Ron brought up is taken care of before the termination of the
permit is complete.

YCPC Councilman Snyder said we also received notification from York
Notify County Planning for the 2008 action plan for CDBG,Home and
ESG program and their executive summary. I looked over that and
Yoe Borough is still on the short list for 2006-2008, three year
funding on CDBG for the Mill Creek Stream Bank stabilization
project. Councilman Allar said that’s what I was going to bring up.
Jason, my recollection is that you sent them a letter changing priorities.
Mr. Reichard said yeah. Councilman Allar sad this is going to hurt,
I’ll call Felicia Dell, tomorrow. Mr. Reichard said Joiann. Councilman
Allar said but Felicia is over Joiann and I mean I’ll call them both.
Mr. Reichard said I’d speak with Joiann because she is with the CDBG
program. Councilman Allar said well I had talked to Felicia Dell about
making sure that we have the priority changed and asked her to confirm
that she had a letter and she did. So I don’t know, I don’t know how
that can get screwed up. Mr. Reichard said I don’t believe there was
ever action taken in it. I know there was a letter basically requesting
that the park job be considered. I don’t remember the exact language
and I know there was a conversation with Joiann and for some reason
she wasn’t making that official. I’m not sure if she wanted another
application submitted, request or not. I don’t know, I have to ask.
Councilman Allar asked do we have to do this over, another
submission for next year? Mr. Reichard said I don’t know, I’d find
out. Councilman Allar said I’d call. Councilman Snyder said it maybe
still going on the fact that when submitted to CDBG, council had ranked
the projects and we had ranked that as #1 because we were following.
Councilman Allar said that’s what I’m saying, we changed the priorities
and changed it officially via a letter. Councilman Snyder said the
council didn’t. Councilman Allar said what? Councilman Snyder said
council didn’t, that’s the thing. Councilman Allar said Jason was speaking
for the council. Mr. Reichard said the letter would have been written on
behalf of borough council. I can’t remember why nothing happened.
Councilman Allar said I’ll check on it and see what’s going on.
The secretary asked if that is for work that’s going to be done through
the end of 2008? Councilman Snyder said yes. The secretary asked
when do you apply for the next three year cycle? Mr. Reichard said I think
this puts us on notice now I haven’t seen the letter. Councilman Snyder
said it just says this is the action plan, detailed information on projects and
activities proposed in 2008 which covers program years 2005 to 2009. Mr.
Reichard said in 2009 they should be sending it out. The secretary asked
if it starts up on January 1, 2009 through 2010 and 2011, do you apply in
2008 for 2009? Mr. Reichard said you apply a year in advance. The
secretary said we should soon be applying for the next three cycle.
Mr. Reichard said they’ll send you a letter. The secretary said then I send

you a copy? Mr. Reichard said we usually receive a copy too. Joiann
talked to me and that they were starting to get their paperwork
together. The secretary said this notice was telling us what has to be done
in 2008 and the way it looked through 2008. It didn’t look like an
application. We will be getting something in 2008 to apply for 2009,
2010 and 2011. Mr. Reichard said that is correct. I usually receive a copy
Too.

Minutes Councilman Snyder said the other thing I have for the engineer and we
YBSA did get the minutes from the September 13th sewer authority meeting.
Again I’m making the engineer and council aware of this because the
clock is ticking and eventually we’re going to get this baby back. I
don’t want it anytime soon, Rodney. Mr. Smith said I think its next
year. Councilman Snyder said I will point it out under the engineer’s
report just tow things to make council aware of in that report. They did
address the one sump pump on Main Street they need more wet
weather to continue that investigation. In the EDU’s, the year of
2003, was a wet year and this year has been dry and in the spring when
the Chapter 94 report comes out, they will be dropping off 2003 which
is giving up a fairly good outlook for next year’s EDU’s. The rest
of the stuff you can look at in the circulate file or something, more or
less.

Subdivision Councilman Snyder said we did receive the latest 2007-08 billing
Rates 07-08 rates from C. S. Davidson which I will take home and incorporate
into the resolution for January’s update of subdivision approval
rates. I guess that’s the best way to say that resolution. I hope
we don’t have any that we have to use it but in the event that we
do. Anything else for the engineer?

Mr. Baade said I don’t really have a lot. The only thing I can tell is the
Wrap Up property owned by Cottrell has apparently been rented, one of his
Properties. They applied for a sign of which we granted a zoning
permit. Turned it over to Dana. He said as soon as the sign goes up
he’s going to hit them with the rental charge. That’s the only
issue on that property. 53 N. Church Street, we have an uninspected
car that comes and goes. There’s nothing I can do with that. If I
catch then while its there. I did catch them one time. If I file now,
it will get thrown out cause I won’t be the zoning officer. So why
file, just keep an eye on that one. Those are the only two things.
Its been fun working with you over the last few years. If your
arrangement with Red Lion doesn’t work out, want me back,
give me a call, if I can, I will. It’s been a pleasure and hopefully
I’ve done good things. I think I have. I wish you all a very

Emergency Management Report

Nov. 14 ,2007 Mr. Smith said on the fourteenth of last month I attended a meeting
Meeting up at Emigsville. It was a rather good productive meeting. They had
about twenty different agencies from around the county there that
rely on different services for the county or whatever. They gave a new
sheet that thye made up for people who have special needs, whatever
their health conditions may be, emergency contacts, primary care
physicians. They would like it filled out and then it would be recorded
on the new CAD system. If an emergency call would come in or an
emergency evacuation they could tell right up front, what they might
need. I don’t know if we could send them out. Probably send them out
with stamped return envelopes, to get them back because people
wouldn’t want to spend money, just take the time to fill it out. They
had a lot of literature there. I brought some of it along. The different
things from the bus company. One good thing, they have a big pill
bottle and it has all the information in there, two stickers, one you put on the front door or wherever you come into and another one on
your refrigerator and they recommend that you keep it in your
refrigerator. And that would have, if we would go into the house, we’d
see that and we would know they need a special medication under special
needs. And we could go right to their refrigerator wherever that’s marked

at and they recommend their refrigerators, everybody puts them in
there. They have a light file. Mayor Sanford said they use to do that
year’s ago, its called the file of light. Mr. Smith said they’re coming
back to that again. They also have a file folder from the County Area
of Aging, to put in it with all your records and put all your insurance
policies, important papers, because of incidents that are happening of you can go there and pull this envelope and could leave one of the, what
a guest doctor there, who has been going around to quite a few of
the emergencies we’ve been having. She was down in New Orleans,
the last one was in New Jersey where they had the flash flood. And all
the people that’s getting displaced, she found the ones that they’re
having that most problems with is the people that are older people and
they don’t’ have any family. One of the questions she asked, when she
was doing her interview, she asked this lady that they had to evacuate
form the second floor of her house. Why didn’t you leave your place
when it was first announced for evacuation? She said well, I saw
the water coming up, I closed my blinds and went to bed. She said
in closing up all their care centers, there are the people that they’re
having problems with, the older people. They don’t understand whats
going on, no place to go and nobody to look after them. She usually,
that’s the problem in every place that she has been throughout the
country. She goes around to do the evaluation. She is a psychologist
at the York Hospital but she also volunteers for the Red Cross of
York County. These file folders are very nice. I’m going to call
and see if I can get more of them. They had the people there from
the bus company. The representatives said whenever we need
buses give them a call. They do go out and answer a lot of calls
for the fire department in the winter especially, to keep the
people warm. They have it for whatever needed, special needs, you
may have for wheelchairs and stuff. We have to let them know. They had
several youth groups there that take of children and youth. York County
has one of the first recovery centers for protection of animals. They
have several places, one of them would be at the fairgrounds. Take care
of any type of animal.Also another place. The problem in evacuating
people from these different incidents, people didn’t want to leave and
leave their animals there. York County has put it together to take care
of animals and all. That’s about it. Councilman Snyder said I just
have one question as you’re getting all this information, now I assume
if we had to have an evacuation here in town, its going to be more
widespread than just here in the borough. But are you keeping a list
of resources like that available at your end for Yoe Borough. Or are
you relying that the county, you’re just bringing this here for our

information and the county’s keeping this. That they have
a database that if we say Yoe Borough needs buses, like
you just brought up, you have a place to go to and they say
this is who you need. Mr. Smith said we went with the county
plan that we can just contact them. Mayor Sanford said the
municipality could opt to go with the county plan. Councilman
Snyder said so they’re basically our resource center. Mayor
Sanford said if we have a situation, the first call would more or less
be to the county. Councilman Snyder said I was just wondering how
much of this Rodney needs to be keeping on file. And just who is
keeping it. Its good information. I just want to make sure that the
people who have it, need it, if the time ever comes. Mr. Smith said
on these forms, the county would like all the information, have it
input. It would be all confidential. Councilman Snyder asked if
that would be sent to the county? Mr. Smith said yes. Councilman
Snyder asked who gave you this? Mr. Smith said York County
EMA. Councilman Snyder said again, I’m looking at this
and this is good information and how do you get the information
out to the people and get them to do it, you’ve got to make it easy
for them. Even if we can say, this is in a PDF file, we could put it as
a link on the borough website. I mean we could photo copy something
like this and come down and pick one up. Mr. Crull said I think the
only way you’re going to get the majority of the, citizens, is if you
talk to the landlords, they’re going to know if they have special
needs people. Up on Philadelphia Street, I think there is a fellow that’s
severely handicapped in one of those apartments. Councilman Snyder
said we do this every year. I’ll put a note in the paper and say that the
EMA requested that any resident with special needs contact them. How
many people do you get? I think we use to have like three or four. I know
that there’s more than three or four in town. Mr. Smith said most of those,
I went around to the two that I knew of. The secretary suggested that you
could send that out when you send out your property rental letters to the
landlords. Mrs. Crull said I think it would be more of a help from the
landlords. Councilman Snyder said how do you get the people to give
` the information. I mean, the old gentleman across from Philadelphia
Street, the ambulance was there a couple of weeks ago. He is not doing
good. And I guarantee you, he doesn’t have anything like this filled out.
I mean its not like you can force the people to fill it out. If they don’t see

Well I didn’t know about it, I didn’t see it. I mean what’s a good way
to get this information out? Short of asking the ambulance, everytime
you respond to an individual, leave one of these with a family member.

Say, please fill this out. I don’t know if that’s something we could ask
them to do or not. They’re not thinking of that, they’re thinking of
the emergency. Mayor Sanford said they would do that, I don’t know
how they would hand that on the scene, but I’m sure they would follow
up after they’re done doing their report. Probably make that out. I could
follow up on that. Mr. Smith said with the ambulance service, we use to
got a letter from the hospital, if one had a baby, special needs baby.
Mayor Sanford said they still do that, either the hospital or the service.
Mr. Smith said they’d notify the ambulance service that if something
comes up automatic with their new computer system, they would give
that information, time and location in the house. Councilman Snyder said
I wonder what the smallest amount is to get a homeland security grant?
Could you get one for $500.00, or $1000.00 grant to say we want to
send this out to every resident with a self addressed stamped
envelope with a letter explaining what it is, that it is kept confidential
and why we need it. And see if we get people to send it back. Even if its
I don’t know, its good information. I’m sitting here thinking maybe its
something for next year. Mayor Sanford said maybe we can get the
Boy or Girl Scouts. Councilman Allar said what about the fire company,
send some kind of notice via maybe newsletter? Mayor Sanford said
that comes out of our marketing company, they go by zip codes.
Councilman Crull asked when is our next newsletter going out,
wouldn’t that be an item that should be in the newsletter then send
these afterwards. Mayor Sanford said we have put it in the newsletter
before. Councilman Snyder said we did put it in the newsletter but we
don’t get any response. Now we have an actual form, at that point
we were saying, notify Rodney, I think we published his phone
number and said give him a call if you have a special needs. This is an
actual form for them to fill out. The secretary said we are going to be
sending the property maintenance forms out in February, we can
start with the landlords and send a copy of that along with it. I know
someone who lives in the borough who will get a copy. Councilman
Noll suggested door to door contact, even verbally, if not you’re
going to be a lot of money. Councilman Allar asked if it could be
sent with the tax bills? Mr. Smith said I talked to Patty last night to
put it in the newsletter. Councilman Allar said you’re going to get
the landlord what about the homeowner. Mr. Smith said you’re going
to have to send a return envelope with it. Several other municipalities,
like Dallastown, said they get very few back. York Township talked
about it. Councilman Snyder said I don’t want to beat his to a dead
horse, I’ll tell you what, I’ll put it in the newspaper like I always do.

get with John. In the meantime if we’re thinking about these
Boys and Girls Scouts, I’m looking at Dana. I’m seeing it’s a slow
time of the year being in the winter and I’m thinking the ARD would
be a prime group of people to say go around door to door and
slip them in the doors and if we have a cover letter with it, or
juvenile probation. Let’s face it, you’re not using them for mowing
and all the normal stuff, painting curbs and things like that. Mr. Shearer
said I wont’ have them back until spring. Councilman Snyder said
I’m sure if you said you have a special project. Councilman Allar asked
what is wrong with sending it with the tax bills? We’re already paying
for the postage, there’s no extra cost. They’re already going out its
going to hit about 95% of the people in town. Councilman Snyder said
probably not that many because if you have a mortgage, it goes right
to the mortgage company. Councilman Allar said its going to hit the
landlords by some other means. Councilman Snyder said and maybe if we
did that that’s something for ARD. There because an issue, I think the
tax bills are manually stuffed. You still stuff them? Mrs. Crull said yes.
Councilman Snyder said you wouldn’t get ARD people to stuff them,
tax bills. Mrs. Crull said no. Councilman Allar said I was thinking if you
want to do it sooner, that’s all. Like Dana said ARD won’t be around.
Councilman Snyder said I’m sure if he called there and said there is a
special project. There we just have to make sure we do it right, that we
don’t put them in mailboxes, literally open the door, shove them in the
door, buy some tape, and tape them unto the front doors. Someone’s
going to see it. Mr. Shearer said that can go the wrong way too.
Councilman Howett said the biggest problem is that people just don’t
care, that’s the bottom line. You can beat yourself to death with this. Even send, personally people, they’re not going to send them back
because number one, they don’t care and number two, they don’t feel
anything is going to happen. People are so complacent about it.
Councilman Allar said there’s only so much you can do. Councilman
Howett said thery just feel that its not going to happen here, its never
going to happen here. The secretary said when you put it in the
newspaper, you can see how much response you get until next month.
I think it’s a good idea to put it in along with the property maintenance
letters. I’m already putting a stamp on it, just put a little blurb, keep
this in your file with your property maintenance license, and when
needed sent it to us. They have to send us tenant changes. Stick it in
the envelope with the tenant changes. And I know one person that I’ll
send it to right now. Councilman Snyder said just to think about it.
These forms are they sent to the county or what? Mr. Smith said they get
sent back to me. Mayor Sanford said we should have a copy, we have

an EMA file here. Councilman Snyder said keep a copy at the borough.
Mayor Sanford will make additional copies. Councilman Snyder said
I just want everyone to realize if God forbid if we have a disaster.
I want us to feel comfortable that at least we did everything we could
on our part. Mr. Smith said its not only for disaster. Councilman
Snyder said for an ambulance all, a fire, they need to know. It was
funny because it just came up, Pete and I were talking about this today.
The fire company was concerned, talking about special needs. They found
out that there was a person in Hallam that was raising cobras. And they
wanted to know how they could regulate these exotic animals because
they’re lethal. I mean it would be nice to know if you have a lethal
animal in your house. Mayor Sanford said that’s why I drive the truck.
Councilman Snyder said I mean this isn’t asking if you have any lethal
Animals in there but its anything like that. It could be for a fire. One time
they were asking do you have any other thing in your house, like large
amounts of ammunition, I have about four pounds of flat powder up in
my back room. They’re probably like to know that, so if they’re going
to go in there for a fire, they’re not going anywhere in the back room
There’s double f, triple f. Councilman Snyder asked that one copy be
sent to the Red Lion Senior Center and let them know that more copies
are available at the borough office. Councilman Allar said you’re
talking emergencies, say something that could happen in the borough
where a parked chlorine truck gets hit by SUV and starts leaking,
does the fire company have any procedure here. They have
certain people designated to go out. I know they county has to
be involved. Mayor Sanford asked for a mass evacuation? Just
drive the truck and make announcements. Councilman Allar asked
if people are designated, instead of one truck. Mayor Sanford said
we take them all out. Councilman Allar asked and you have a way
like in a half hour to cover every place in town? Mr. Smith said the
one thing we don’t have in town is the civil defense siren, its out
of service for two years now. Councilman Snyder said one thing I
know driving Santa around, I think everyone knew Santa came to
town. So I think going around with a bull horn on the trucks works.
People who were in town could hear it. People who would be out
of town would hear it in the news quickly. That would make every
radio. Councilman Allar said they may not be watching. I think
the truck and bull horn is the only way to go. Mayor Sanford said
we would cover all the areas. Councilman Snyder said people
who aren’t in town, wouldn’t be able to get back into town. If
I’m at work, I just wouldn’t be able to get into town. Councilman
Allar said that would be good, with all the vehicles.

Councilman Snyder said oh yeah. Mr. Smith said I have that in
the plan. Councilman Noll suggested that we could amend the
rental ordinance to have this information upon inspection. That
you have it all down. Councilman Snyder said we need to update
that anyways, we had discussed having to redo that ordinance to
capture properties who are saying they are not rented. Basically
it would be any property that’s not owner occupied. We have an
instance, I’ll use Ron as an example. He owns the property or he use
to own the property on Elm Street where Deb lives. So he can tell us that
he’s not renting because its his daughter but we don’t know that for a fact.
He maybe renting that, its all under the table. So the idea is, if that
property would be in his name, and he’s not living there its going
to be deemed a rental property for the use of the ordinance. And that way
we don’t like Cottrell down here, we know he’s renting but we can’t
prove he’s renting and that will take that out of the equation. And that’s
one of those things even thought they’re not getting compensated for
it, that means en facto they are renting it, they’re just not getting
compensated and you want to do the same thing as you do for the
rental property. So it was just a little blurb that we wanted to change in it.
We could change that at the same time, that they have to pass one of
these unto their tenants once a year. Okay anything else of EMA?
Councilman Crull said I got your idea, but my daughter’s name is on that
property also. Councilman Snyder said yeah. Councilman Crull said
before that rumor gets around, renting of that place. Councilman Snyder
said I was just saying you as an example, cause it was easy to come up
with. Now you’re going to be able to swear to that. Councilman Crull
said you can check the records at the court house. Councilman Snyder said
just kidding.

Mayor and Police Report

Juvenile Mayor Sanford said correspondence, I’ll hand that to you with the offer
Probation for help if interested. I sit on a committee at school, with this young
lady that oversees juvenile probation, they are also looking for avenues
for work for the kids for public service, like first offenders. And there’s
stuff in the borough, that we could do. I’ll pass this around. Councilman
Snyder said to be totally honest, I’ll officially pass this on to Dana. If
You have some down time or something, read over what they do as
far as what they offer and see if you see a need there, if we can use them.
Mr. Shearer said maybe they’ll show up more than the adults. The adults

don’t like to come here and work. Mayor Sanford said
the part time staff can’t do this. Councilman Snyder said
I am familiar with the program and I know that they expunged
people’s records if they do it, its for nonviolent first time
offenders. And most of the time, well its not expunged, they
never follow through with the charges, so the charges are dropped.
Mayor Sanford said we do that a lot up at the school. Councilman
Snyder said they’re more apt to actually do something. Now what
they can provide or what their criteria is, I don’t know but I think
Dana is a better handle whether. Mayor Sanford said its
pretty broad. Councilman Snyder said I don’t know because of
hours, if it has to be on weekends versus weekdays. Look over it.

Oct. Mayor Sanford said York Area Regional Police reported the following
Police for October 2007: 46 calls, 2 accidents, 3 accidents with injuries, 14
Report traffic citations, 2 summary citations, 4 misdemeanor felony arrests,
2 juvenile arrests. Service hours for the month of October are 58 hours
and administrative hours 32.70 hours. Reading in the minutes, there
was a question how the numbers, that the numbers did not add up.
They do add up, if you look at the report, there’s type 1 calls, type 2
calls and general miscellaneous and those three I add up to
get my total calls. So they do actually add up across. Type 1 are
and I ‘d have to get a breakdown which I can, I think type 1 are
very serious calls like rapes and things like that. The lesser are
type 2 and goes down from there, like barking dogs, parking and
stuff like that.

Police Also relating back to last month’s minutes, I will start my term
Commissioner as the newest police commissioner for the regional force at the
beginning of January. I do sit in for the alternate. There’s two
commissioners for York Township, two commissioners for
Windsor Township and a citizen at large from one of the other
municipalities. I sit in and have a voting right if that citizen at
large is not present, which in November, he was not present.
But that sixth commissioner does get a voice in all the discussion
and becomes part of the executive session. Councilman Allar
asked if its just the citizen at large, its not for the others? Mayor
Sanford said no, its just for the citizen at larger when they are
Absent. Councilman Allar asked if the alternate ever voted?
Mayor Sanford said yes, last month in November. It doesn’t
go on a lot, a couple of times a year. Councilman Allar asked
if your term is a year? Mayor Sanford said yes. Councilman

Snyder said at least you get to sit in on the discussion of the
executive session. And you’ll get into the contract negotiation.
Mayor Sanford said I’m hoping they get that settled before I
take office. I really hope for that. Councilman Snyder said then
you’d be going to a lot of executive meetings.

Weight Mayor Sanford said there was a traffic citation issued dealing with
Restriction weight restriction. It was issued on Elm Street about forty five days
Citation ago. The fine was very expensive. It was on a tractor trailer, the
tractor trailer was empty .They went by what was wrote as, the
total gross weight of the vehicle, the fine was based on the total
gross weight of that tractor trailer, which was thousands and
thousands of dollars. We are waiting for word to see when that
is paid. So that will be the first citation that I’m aware of. Councilman
Allar asked that they came upon it themselves? Mayor Sanford said
Yes, they just happened to drive up on them. Actually it was heading
back by Orchard, toward the House of Windsor in that direction.
Right place, right time. Officer Zech was the one that happened to be
at the right place at the right time.
Arrest There was also an arrest at the ballpark on Sunday afternoon. I came
At Ballpark in to check for mail and I observed a vehicle sitting at the ball park.
Something just didn’t look right. So I watched them through the
garage window, things progressed downhill so I had a car come in.
The driver was arrested for two outstanding warrants in the city.
Councilman Allar asked what was he doing? Mayor Sanford said
sexual activities plus littering. Mrs. Crull said she saw the vehicle when
they got home. Mayor Sanford said if you see it again, call it in. They’re
ban from this area forever.

Street Cut Mayor Sanford said I have a question on the street cut that was made
? in conjunction with the fire hydrant on George and Main Streets. Is
that going to be fixed any better? Mr. Shearer said yes, they will get
that when the weather improves about six months until it settles out.
Mayor Sanford asked that’s not going to be a problem with a plow?
Mr. Shearer said it may be a little but the state takes care of that.
While you are on the subject, Sandy will probably elaborate later but
its been billed, Sandy got the check for the initial bill and they were
notified that we will be additionally billing for the sidewalk and street.
Mayor Sanford asked are you keeping an eye on the sidewalk as it sinks,
that it doesn’t become a trip, fall hazard? Mr. Shearer said hopefully
we’ll be able to get Restuccia in there when we get some nice weather
so it can be fixed.

1st Snow Mayor Sanford said it was kind of ironic that when we had the first
Storm snow storm after we had all the big thinkers in town, we got part
time people, we had our p’s and q’s. All the part time people were
away. You were away? Mr. Shearer said no, I was here plugging away.

Training Mayor Sanford said for our newest council person, there’s some new
borough official training that we can forward to you. Unforunately
the two closest are in Adams County and one in Harrisburg.
We’ll get you information on that.

Invite Mayor Sanford said I wanted to ask, did we ever get an invitation to that
Sept. 20th from anybody? Councilman Snyder said not that I know of. I wanted to
ask you about it. Mayor Sanford said this is the kind of stuff, we should be
asking about. Councilman Snyder said and considering they were there.
I was just going to bring that up for your benefit. Mayor Sanford said no, I didn’t know anything about it until I read about it with the minutes.
Councilman Snyder said let the record reflect that what we’re discussing
is the letter we received from Ron Miller’s office that Jacobus Borough
hosted a public safety forum on September 20 and York County
Adult Probation and Kathleen Burke with York Area Regional Police
Department presented information on gang activity as part of its forum.
And they were enlightening people as far as what to look for as far as
gang symbols and stuff. I was going to bring that up under the Mayor’s
Report. And as the mayor had indicated we didn’t know anything about
it. And I just mentioned that maybe since the police department was
there, he’s a commissioner of the police department for the borough,
he should bring it to someone’s attention that Yoe Borough was never
contacted or invited.

Meet Councilman Allar said a couple months back we mentioned about
With Police getting a police officer to come here and give us any information
on criminal trends, vandalism, drugs, things going on in the borough.
Have you set something like that up? Mayor Sanford said yeah,
originally we had, that the chief and another officer were going to
come down in November and we put that off based on the conversation
that I had with Sam. We didn’t do anything this month either but when
things slow down. Councilman Allar said I don’t’ think we need the
chief of police. Mayor Sanford said no, he doesn’t get out of the office.
Councilman Allar said usually something like that is down in the rank
and file on what’s going on. Mayor Sanford said I was thinking one of
the sergeants or corporals could come out and talk. That’s on, on eof
my to do lists.

Post Mr. Shearer asked about with the recent incident with the trespass at
night, do we need better signage to enforce? Trespass signs or a dawn
to dusk light? Mayor Sanford said no, because when they go in there,
they’re going to be doing something bad. So just call, we’ve got to
call, if you don’t call they aren’t going to come out.

No Parking Councilman Snyder said while we’re discussing that I will bring up
Only for to council’s attention. Again, if council doesn’t want to do anything about
Borough it, that’s fine. We were notified when we spoke to Sergeant Blair that
Business they will enforce parking restrictions here on the borough property, if we
post it. The last time that I brought that to council’s attention I think
there was one council person that’s not longer here, who was one of the
most person against it. I know it hasn’t been an issue, here since that
came up. If we want to do it, we need to post and they will enforce it.
All we have to do is get the proper wording as far as parking for borough business only and I think that was about it, they would enforce
it. We had that one issue when we had that meeting, there was a big
truck out there. There was a couple of other meetings that people,
we do see people parked there when its not normal business hours.
It doesn’t affect anybody at that time but they also don’t know when
there’s a sewer meeting scheduled or something like that. Councilman
Allar said one was a volunteer fireman. Councilman Snyder said well
he lived right here, Garman. Councilman Allar said wasn’t there a
group too. Councilman Snyder said they wanted to park here to meet.
Mayor Sanford said they are using the body shop lot. Councilman
Snyder said again I just wanted to bring it up to council’s attention.
If we wanted to make sure that the parking lot is open. We can post it.
Councilman Noll asked what is the downside? Councilman Snyder
said I think one of the things, what was Karen’s biggest gripe?
Councilman Allar said I thought it was that some group wanted to use
it. Councilman Snyder said a group wanted to use it and she
was complaining that there’s not that much parking in the town to
begin with and its public property and people should be able to park at
a borough building. Mayor Sanford said that actually came up at two
different times. The requests from the ladies. Councilman Snyder said
yeah, they came up twice, almost simultaneously. Mayor Sanford said
a month after each other. Council’s thinking was if we allow them to
park here, we take liability for anything that happens as they’re getting
to that house. Councilman Snyder said there also came an issue when,
I don’t think we had this block party this year. But there was a
gentleman up the street on High Street who had a block party for
four or five years running. This year I don’t think he had one but I mean
we’re talking about 40, 50 cars were parked in here. Now he did

come and ask permission. It was like one day before and we had
discussed it, we would rather have him parking here than on the
street. Yeah but we didn’t like the way it went down. Councilman
Allar said you probably should post it. The police, they all know
what our meeting schedule is, if they see a car that doesn’t belong
there. Mayor Sanford said if they come in and the door’s not open
and the lights aren’t on, then. Councilman Allar said and if the
closed sign is on the door that’s all they need. Councilman Snyder
said I would think they would check that its not one of us on
borough business. Like Sandy was done here today, and I happened
to come down too. The office was closed but we were here on
borough business. Councilman Crull said you could put the open
sign up. Councilman Snyder said its not like you are open. The
secretary said I don’t want anyone to know that I’m here, I am
here to get work done uninterrupted. They should know my car.
Councilman Howett asked what about certain times, why can’t we
just post it private property. The most time you have a need for
extra parking is at night time. Councilman Snyder said for
borough meetings, for zoning meetings. Councilman Howett
said for certain times. Councilman Snyder said people park here
for ball games. The secretary if I’m here on a Tuesday, I’m here
for borough business. Councilman Snyder said that’s what he
said, no parking except for borough business. Mayor Sanford
said there were some concerns that they’re was a large tractor
out here periodically, now that hasn’t been here for awhile.
Councilman Crull asked do you need a motion for it or a
hand vote is good enough. Councilman Snyder said probably
since we’re designating it as no parking except for borough
business, take a motion on it. Councilman Allar said one way
to handle that, is to get a cheap borough official sign. Councilman
Snyder said if he comes through and we can work this out with the
mayor. If you see a personal vehicle here, walk around and see if
there’s anyone in the building. If there’s no one in the building then
you know they’re not here on borough business. Councilman Allar
said you’re putting more duties on the officer. Councilman Snyder
said for the most part I don’t need them to be a cop, its when
we’re here and we’re having a meeting and there’s a truck parked
here. It shouldn’t. Mayor Sanford said most of this is going to be
generated by call ins, by complaints. Councilman Snyder said
I mean when we were trying to have that zoning hearing that
night, where he was parked was absolutely ridiculous. A motion
was made by Councilman Noll to post the borough municipal

building and office as no parking except for borough business,
borough business only and for Dana to purchase the appropriate
signage and to check with York Regional to make sure the verbage
is correct. The motion was seconded by Councilman Allar. All in
favor. Mayor Sanford said he will check on the verbage. Councilman
Snyder said I think that’s the whole key, its going to be generated
by complaint. Anything else for the mayor?

Secretary’s Report

New Effective January 1, 2009 our new email address will be YoeBorough
Email @comcast.net . The secretary said what I’m going to do is I kept
the important emails and I will reply giving them the new email
address. I will be notifying NFDC to cancel service December 31.
The cable is in and the cable is in for the televison. Mayor Sanford
asked how does this coincide with the email address on the
website, Bruce? Councilman Manns said I will have to take a look
at it and update it.

Appoint The secretary said Patty Myers needs to be appointed as a
representative to the Dallastown Yoe Water Authority beginning
the three year term on January 1, 2008. I also gave you the meeting
dates for 2009. Mr. Smith said the sewer authority meets on Thursday.
The secretary said I already contacted the authority secretary for
the dates of the sewer authority. Councilman Snyder said on
Patty’s appointment, go to love this borough newsletter. You’ll
be receiving this once you get into the system. It’ll probably take
eight months, it takes awhile. Based on the information the
secretary provided with the expiration of Patty Myer’s term.
According to an answer in the question and answers in the borough
newsletter, it states every December, the borough council makes
appointments to boards, commissions and committees based on
the expiration of the term. A former official said that’s incorrect and
you can’t do it that way. The answer: Each law has different
requirements regarding the length of terms such as hers which
has a three year term limit. Some positions do not expire until
the first Monday in January such as municipal authorities. You
just said hers expires January 1, 2008. Commonwealth Court
ruled Ross Township vs. Menhorn, that a lame duck appointment
which we are a lame duck committee, council at this point,
to a municipal authority is illegal because the term did not expire
until January. Therefore the new council has to make the appointment.

The Pennsylvania Municipal Authority’s Act has been amended to
reflect that action. So I would think based on that. The secretary
said the she can’t serve until January 7, 2008. The she can’t attend
any meetings between Jan. 1 and Jan. 7. Do you have any meetings
between the first and seventh. Councilman Howett said no. The
secretary said okay. Mr. Smith asked about the sewer authority.The
secretary said your appointments are done for March that’s when
the authority began. Councilman Snyder said we can do it at
reorganization. The secretary said I will put it on my report for next
month.

YCPC Councilman Snyder said YCPC sent information in an effort to
Emailing streamline communication with the county municipalities we’re
preferring to use email. They’re asking for email notifications,
to notify them as to what the email is so they can notify us in
timely efficient fashion.

Penn Waste Councilman Snyder said we received notification from Penn Waste
Holiday about holiday collection. That doesn’t affect Yoe Borough residents
Collection as the holidays fall on Tuesdays and Monday collection will be
collected as scheduled.

Commerce Councilman Snyder said we did receive a basket from Commerce
Bank Bank filled with snacks. They’re looking for some business.

2008 Councilman Snyder asked if Jason got the meeting dates and did
Meeting he take them with him. The secretary said they were given to him and
Dates they were sitting right in front at him at the meeting. Councilman
Snyder said we need to approve the meeting dates for 2008. If everyone
wants to look at a calendar, what is tentatively scheduled is
Monday January 7, that is mandated by state law. I guess you can
Contest that these are all the first Tuesday? The secretary said no,
November and December are the second Tuesdays, like you always
have had them. Councilman Snyder said its basically the first Tuesday
except for November and December which is the second Tuesday
because of election day and hunting season. The other dates are:
February 5, March 4, April 1, May 6, June 3, July 1, August 5,
September 2 and October 7. Then of course the Yoe Borough Sewer
Authority will hold their meetings on a quarterly basis and those
dates are March 13, June 12 , September 11 and December 11.
So based on Sandy checking the right calendar, which I feel
comfortable in. A motion was made by Councilman Howett to

advertise and approve the meeting dates for 2008. The motion
was seconded by Councilman Allar. All in favor. Councilman
Snyder said meetings are set.

Revitaliza- Councilman Allar said I met last Thursday with Mike Waugh, on
tion the revitalization grant. Good news is this something he would support.
Grant Bad news is, back in March, nine months, I was asked why no one
Application bothered to come to him because it seems now that cycle is expired.
So the application is no longer any good. The cycle, we are in ends
at the end of this month and in his mind, he already has a lot of
commitments worked out. However if we can do this, new signatures,
new dates, several application numbers, we’re going to have to get it
in. Really it needs to be done next week. The secretary said its not
going to happen next week. Councilman Allar said then we can get into
this cycle, then I think I’ve sold them on it, depending on how many
commitments he has or we’re going to miss it again. That’s where it
is. The person deal with isn’t Paula anymore, its Nadine, here’s her
number. Like I said from last Thursday. The secretary said its not
going to happen next week with the council meeting only about three
weeks away and our new grandbaby arriving soon. Councilman Allar
said we’re trying to get something together with the DCNR grant.
Mayor Sanford said before I had talked to her. Councilman Allar said
you’ve got to grab him by the lapel and sit down with as I did.
Mayor Sanford said I spoke with Nadine herself. Councilman Allar said
Mike’s the decision maker, he’s the guy you’ve got to get to. Mike told
Me, get it in here. So this cycle. The secretary said that’s not the
impression I got at all. Councilman Allar said this is the second time I’ve
gone through this. The secretary said in talking to you and from talking
them, Mr. Waugh would represent us when it went up there. There was a
chance we wouldn’t get it. That’s the last thing, the impression they left
me under. They didn’t say keep bugging them to see where the grant is.
They didn’t tell us that. Councilman Allar said you’re not hearing what
I’m saying, its staffed with political people. They don’t know if there is
Someone on the other line taping them or not. They have to say that to
be even with everyone that comes in. When it comes down to Mike,
himself, its his money, his allocation, he makes the decision, and if
someone in the back. He’s going to tell the staff to make the phone call,

cause I want to give this entity $10,000.00. The secretary said they
didn’t tell me that, that’s not what they told me. Did they tell you that?
Mayor Sanford said no. Councilman Allar said no, they won’t tell you
that. Its set up as a grant where people in Harrisburg make the decision.
The secretary said so the signed support letter didn’t mean a thing?
Councilman Allar said that’s absolutely right, it means nothing. The
secretary asked what do we do differently this time then? Councilman
Allar said since its decided by the elected official, you need to sit
down with the elected official and get a commitment out of him.
I said this when we put it in. The secretary said they did not say that.
Councilman Allar said they can not say that. The secretary said if
we apply next week, then you are going back to sit with them next
week? Councilman Allar said I sat with him last week, I already
sat with him. The secretary asked it’s a done deal if we apply next
week? Councilman Allar said I’m not saying it’s a done deal because
so late in the session. Mayor Sanford asked does he have more money
for January? Councilman Allar said he has money for this cycle.
The cycle that we put in for has already started, so as is, to make
this thing official, we have to have certain applications. This
application number is no longer any good. We have to do another
application, get another number, change some dates and signatures
on it. The body doesn’t have to change, every thing in there we can use
but we have to update it for this cycle. The secretary asked if Nadine
knows how to update? Councilman Allar said she will tell you what
needs to be done. The secretary said I don’t want to promise anything
because I may not be in next week. I won’t be able to call until
Friday. Councilman Snyder said if he has money for this cycle, the
he doesn’t have any monies earmarked yet for the next cycle The worse
thing that would happen is that it would be pushed until the next quarter.
I mean we are not even ready to move forward on the DCNR part.
Councilman Allar said that’s the point, if we want to move forward with
the DCNR that’s what makes this cycle right now at the end of
December more critical. Cause you’re going to get a decision this
cycle a lot sooner than the next cycle. Mayor Sanford asked if you have
the form in your computer. The secretary said I filed it at their office,
they did if for me. I’ll give her a call on Friday. I’m saying to get
it in for the end of December, its going to be difficult. When I went there,
they didn’t tell me to get a hold of someone,that you could have met
with them in March. Councilman Allar said that’s something else, I
don’t want to get into that. Ther secretary said that wasn’t the
impression that we want. They didn’t tell us that we were
personally to meet with them. Councilman Allar said if you want

to get with Saylor, it would be a good time. Mayor Sanford asked
if Ron Miller needed to be contacted again. Councilman Allar said if
he was, yes. Waugh, is the big player, he gets a big allocation. Yes,
it can’t hurt. Miller is going to say, give me a copy of the application.
Saylor is going to say give me a copy of the application. Mayor Sanford
Said I had to call Nadine to get the number and gave it to Ron’s
assistant down there. I thought by making a call to the office and letting
them know what it is for. Councilman Allar said I’ve tried to explain,
you’ve got to get to the decision makers, you know its not handled by
the staff, the staff had their line, they can’t show preference in any
direction. Mr. Shearer said I’ve put in for equipment and we’ve had
their staff call us up begging to fill that in and we never talked to Ron.
Councilman Allar said I think it depends who you’ve gone to. Mr.
Shearer said that’s probably true too cause Mike has a bigger area.
Councilman Allar said that’s true. Mike is getting deluged by these
things. If you want to separate yourself from the pack, you talk
to the guy. Mayor Sanford said just to clear this up, because I think
there is some misconceptions. So I’m just going to say this, when I left
a message for Ron and saw him less than thirty days later at a meeting
sitting beside him like this. I asked did you get my message about
the money that we’re trying to get for the park. He said yeah, I’ll
see what I can do. That’s not good enough? Councilman Allar said
with who? Mayor Sanford said Ron Miller. Councilman Allar said
you talked to Ron Miller. Mayor Sanford said that’s what I just said.
Councilman Allar said yeah. Mayor Sanford said that’s not good enough?
Councilman Allar said if you talked to Ron. Mayor Sanford said
and I left a message with Nadine when I got the number when we said,
I called in there and got the number because Sandy didn’t have it so that
Ron Miller’s office could have it. I said would you have a message for
Mike to make sure that he looks at this for us. Councilman Allar said
I’m here to say, Mike was not familiar with this grant, he never looked
at this grant. I had to explain it all the way through. Cause he gets so
many of these things. Personal meeting, is pulling out the grant and
sticking it in front of his nose. Mayor Sanford said I feel like you are
making accusations. Councilman Allar said no, I’m just saying
what the facts are. He had no knowledge of it. Mayor Sanford said
I am telling you at this meeting that they were both notified so you can
go with that wherever you want to. Councilman Allar said you mean,
their staff was notified. Mayor Sanford said Ron Miller sat beside me
and told me, he knew about it. Councilman Allar said I’m not talking
about Ron Miller. I don’t know anything about Ron Miller. I’m just
talking about Mike Waugh. Councilman Snyder said if it can be done,
if not. The secretary said its not on top of the priority list right now.

Buses Councilman Crull said I wasn’t here last month, but I had a complaint
from a lady on Elm Street and one from a lady on Walnut Street about
the continuous line of buses. Do you remember what time they said
that was? Mrs. Crull said when they’re heading toward the school,
morning and evening. Councilman Crull said maybe its stopped since is
a month old. Mayor Sanford said not our bus drivers. I have nothing to
do with that. Mrs. Crull said I’m just saying the bus drivers were out there.
Mayor Sanford said you already have my attention. I’ll make a call to
Larry Markel. Both the mornings and evenings? Mrs. Crull said yeah.
I’m surprised they go through Walnut with that curve.

Final Councilman Snyder said we have to do final adoption of the budget
Adoption for 2008. Nothing has changed since the preliminary. The tax
Of Budget ordinance has already been adopted which supports the budget.
Any further discussion, otherwise? A motion was made by Councilman
Howett to formally adopt the 2008 budget. The motion was seconded by
Concilman Crull. All in favor. Councilman Snyder said budget is
Adopted.

Experience Councilman Allar said Barry, Bruce and I, we met with the Work
Works Experience people, Experience Works I guess. We interviewed
Sheridan Lewis. I should have been in with your minutes, his
biography. He has experience with computers and a good running
background. I also have attached a summary of the grant support.
If anyone has any issues with that, just get in touch with me.
We do need to approve that agreement and then there’s some other
paperwork that has to go to the Department of Labor, so he can get
paid. I don’t have that but I’ll get that probably this week or next
week. At least with the agreement, Pete said he was going to look
at that to see if everything is okay on that. Councilman Snyder asked
if he has a copy of that? Councilman Allar said no. I think they
gave it to you or Pete. To get the ball rolling and not waste any more
time on this grant stuff. They can’t do anything officially until they
get that. If he has it , Tell him to fax it back to us. Let me know
I can call them and say, mail it. Councilman Snyder said I have to
check with Pete. Let’s say we’ll be calling them for another copy because
if it got into his file to check over. The secretary said I didn’t have a copy.
Councilman Allar said let me know. There agreement is going to be okay
because they have an agreement with 500 other municipalities. A motion
was made by Councilman Allar to sign that agreement with Experience
Works once we get confirmation from the solicitor and to locate the
actual agreement. The motion was seconded by Councilman Howett.

Insurance Councilman Snyder said with the change of insurance at the retention
At Dams dams. We did get a refund check of $193.00 for what the balance is.
They just need a signature in order to change the policy. I know
there was discussion made in order to actually change the policy and
do we want a motion to actually change it. Councilman Allar said
we already did that. Councilman Snyder said I couldn’t remember if
we did or not. I know we discussed it and said it was a good idea but
I don’t know if we made a formal vote. The secretary said we made it to
change the limits to $400,000 to make sure it went through. This is a
formality, it has to be signed so that insurance company can legally
take the limits down. A motion was made by Councilman Allar to sign
for the actual change of the policy to reflect those changes that were
discussed at last month’s meeting. The motion was seconded by
Councilman Howett. All in favor. Councilman Snyder said motion
carried.

New Business
There was no new business.

Payment of Bills

Councilman Snyder said we have additions to the bills: Milt’s Repair
Service for $496.90, for the annual inspection of the traffic light. Mayor Sanford said
they replaced them with standard bulbs. Councilman Howett said one was replaced
that was burned out. Councilman Snyder said he’s still not putting in LED’s. It says
135 watt traffic signal light, 69 watt traffic signal amps. South bound red light signal
light flasher, 135 watt. Mayor Sanford asked wasn’t Barry going to call him to start
doing that. It looks like he pulled all of them out and replaced them with standard
bulbs. Councilman Snyder said I know he said it was going to be expensive,
I thought they deal was as it was burned out, he was replacing them with LEDs. I haven’t seen bulbs burned out before but I haven’t seen one LED go in. Mr. Shearer said I’m
not sure about that, I don’t know if you have to relamp the whole thing because of the
changes. Councilman Snyder said the point is, at this point they were not changed to
LEDs. So $496.90 for that. Expenses for the tax collector for 2007 is $238.71. Griffith,
Strickler, Lerman, Solymos and Calkins for billing through November 30, 2007 is
$3765.70. Of course based on our discussion earlier in the meeting, portion of that
will be rebilled back to the insurance carrier. So with those additions onto the bill
list, any questions or comments? A motion was made to pay the bills with the
additional items mentioned by Councilman Howett. The motion was seconded by
Councilman Allar. All in favor. Councilman Snyder said bills are paid.
